Entire Creditor Trust Agreement. This Creditor Trust Agreement, including the Exhibits attached hereto, the Plan and the Confirmation Order contain the entire agreement between the parties and supersede all prior and contemporaneous agreements or understandings between the parties with respect to the subject matter hereof. For the avoidance of doubt, to the extent holders of Allowed Claims that would otherwise be entitled to receive Units have established or in the future establish trusts or other entities or vehicles to facilitate the implementation of the Plan with respect to their Units or for other purposes, the agreements governing such trusts or other entities or vehicles shall not limit or impose requirements in any way on the Creditor Trust, the Creditor Trustees, the Creditor Trust Board, the Creditor Trust Administrator, the Creditor Trust Management or any other employee, agent or representative of the Creditor Trust, and to the extent there is any conflict between the provisions of such agreements and this Creditor Trust Agreement, this Creditor Trust Agreement shall have controlling effect.
