Entitlement to payment. (i) An Employee shall be entitled to payment by the Employer for Ordinary Time Earnings lost through Inclement Weather for up to 32 hours in every calendar month. For the purpose of this sub- clause the following conditions shall apply: (A) an Employee shall be credited with 32 hours at the commencement of each calendar month. (B) the number of hours at the credit of any Employee at any time shall not exceed 32 hours. (C) if an Employee commences employment during a calendar month the Employee shall be credited 32 hours where the employee commences on any working day within the first week; 24 hours where the employee commences on any working day within the second week; 16 hours where the Employee commences on any working day within the third week; and 8 hours where the Employee commences on any working day within the fourth week. (D) no Employee shall be entitled to receive more than 32 hours Inclement Weather payment in any calendar month. (E) the number of hours credited to any Employee under this clause shall be reduced by the number of hours for which payment is made in respect of lost time through Inclement Weather. (F) payment under this clause shall be weekly. (ii) Provided further and subject to clause 32.3(g)(i)(C), an Employee working on a part time weekly basis shall be entitled to payment on a pro-rata basis according to the number of ordinary hours agreed to be worked in the calendar month. Entitlement to payment. Xxxxxxx, other than casual kaimahi, shall be entitled to payment of salary from the day of commencing duty until the day on which duties cease (apart from periods of leave without pay) subject to the following conditions: a) Payment includes all statutory holidays, leave periods and intervening weekends. b) On resignation or retirement, xxxxxxx who complete the normal full working week shall receive payment for all statutory holidays immediately following. c) When the employment ceases the kaimahi will receive payment of any outstanding pay within 10 working days of cessation of employment. d) Annual and discretionary leave due on resignation or retirement shall be payable as follows: i. Xxxxxxx who resign at the end of the Te Pūkenga year shall receive payment up to the end of any period of leave due. ii. Xxxxxxx who resign during the year (kaimahi with short service) shall receive payment as set out in their divisional schedule.

The method of calculation of a part-time daily hire employee’s proportionate employment will be as follows:

For the purposes of this clause, the following conditions will apply: (a) An Employee will be credited with 35 hours at the commencement of each calendar month. (b) The number of hours at the credit of any Employee at any time will not exceed 35 hours.
Entitlement to payment. (i) Employees working in inclement weather shall be paid at a double time rate. The minimum payment for inclement weather shall be two (2) hours additional pay. In cases of inclement weather when employees in the crane yard are not required for a specific task and the inclement weather is not likely to xxxxx, consultation between management and the employee representative (if the employee representative is unavailable the employee/s affected) must take place to consider allowing the employees to knock off without loss of pay. It is also agreed that the employees must make themselves reasonably available if needed for emergency or jobs in areas that may not be inclement in ordinary working hours.

B.15.3 If an employee commences employment during a four weekly period they will be credited eight hours for each week, or part of a week, that the employee is employed during the four weekly period. B.15.4 The number of hours credited to an employee will be reduced by the number of hours for which payment is made. B.15.5 Payment under this clause will be weekly.

Entitlement to payment. In the event of such termination by the Owner, the Contractor shall be entitled to payment for the Work properly performed up to the time of the termination and reimbursement for such actual costs as are reasonably incurred by the Contractor due to the termination and not otherwise compensated. The Contractor shall also be entitled to profit on the amounts payable to the Contractor, but such profit shall be limited to six (6%) percent of such amounts. The Contractor shall not be entitled to any payment, including any anticipated profit, on Work not performed, and the Contractor shall not be entitled to any compensation or recovery of damages for any other costs, losses or damages of any nature.
Entitlement to payment. In the event an Indemnifying Party elects not to assume control of the defense and settlement of that claim, the Indemnified Party will be entitled to payment by the Indemnifying Party upon the Indemnified Party’s settlement of the claim or the adjudication of liability, whichever first occurs.
Entitlement to payment. In the event of termination of this contract under Article 10, the Contractor shall be entitled to payment from the Translation Centre only in respect of the work or part(s) thereof completed at the time when such cancellation or termination occurs.
