Environmental and Social Safeguards. 1. In carrying out Sub-projects, the Borrower shall: (a) ensure that the proceeds of Kecamatan Grants shall not be used to finance the acquisition of land; (b) take measures to avoid or minimize the acquisition of land or assets of villagers, and to avoid the displacement of such villagers; (c) where the acquisition of land or assets, or the displacement of people is unavoidable under a proposed Sub-project, ensure that the Beneficiary shall, before carrying out the works which would result in such acquisition or displacement, provide to such people, adequate compensation, and other resettlement and rehabilitation benefits, in accordance with the Land Acquisition and Resettlement Framework; and (d) in the case of the physical displacement of persons involving the loss of more than ten percent (10%)of their productive assets or the displacement of more than two hundred (200) people as a result of a Sub- project, ensure that: (i) a Land Acquisition and Resettlement Action Plan shall be prepared in accordance with the Land Acquisition and Resettlement Framework, and furnished to the Bank for approval; and (ii) prior to the carrying out of the Sub-project, ensure that all Displaced Persons shall have been compensated and provided with applicable resettlement and rehabilitation benefits in accordance with the provisions of such Land Acquisition and Resettlement Action Plan. 2. In carrying out Sub-projects, the Borrower shall: (a) avoid, and, if not possible, minimize cultural, social and economic adverse effects on Isolated Vulnerable People, caused or likely to be caused by the Project, by taking appropriate mitigating measures; and (b) through a process of informed participation, involve concerned Isolated Vulnerable People in the design and implementation of Sub-projects so as to ensure that the benefits received by the Isolated Vulnerable People under the Project are in harmony with their economic, social and cultural preferences, and likely to protect their customary user rights. 3. In carrying out Sub-projects, the Borrower shall ensure that the provisions of the Environmental Management Framework have been complied with and, where applicable, an Environmental Management Plan fully consistent with this Agreement and the Environmental Management Framework has been prepared and agreed in writing between the Borrower and the Bank upon and applied in the implementation of such Sub-project.

3. In carrying out Sub-projects, the Borrower Recipient shall ensure that the provisions of the Environmental Management Framework have been complied with and, where applicable, an Environmental Management Plan fully consistent with this Agreement and the Environmental Management Framework has been prepared and agreed in writing between the Borrower Recipient and the World Bank upon and applied in the implementation of such Sub-project; (b) giving details of measures taken in furtherance of the Environmental Management Framework and each Land Acquisition and Resettlement Action Plan; (c) conditions, if any, which interfere or threaten to interfere with the smooth implementation of the Environmental Management Framework and any Land Acquisition and Resettlement Action Plan, and remedial measures taken or required to be taken to address such conditions.
4. Without limiting the obligations under Section II.A of this Schedule 2, he Recipient shall take all measures necessary on its part to regularly collect, compile, and submit to the World Bank, as part of the Project Reports, (a) information on the status of compliance with the Environmental Management Framework, Land Acquisition and Resettlement Framework, each Land Acquisition and Resettlement Action Plan, and the Isolated and Vulnerable Peoples Framework.
5. In carrying out Sub-projects, the Recipient shall not amend, suspend, repeal or waive, or permit to be amended, suspended, repealed or waived, the Environmental Management Framework or any Land Acquisition and Resettlement Action Plan with the prior written agreement of the World Bank and the Recipient.
6. In the event of any conflict between the provisions of the Environmental Management Framework or any Land Acquisition and Resettlement Action Plan and this Agreement, the latter shall prevail.

Environmental and Social Safeguards. 1. In carrying The Borrower shall ensure, and cause BSIF, and the Participating TCCs to ensure, that the Project activities are carried out Sub-projectsin accordance with the Safeguard Instruments, including the guidelines, rules and procedures defined in said Safeguard Instruments. (c) where the acquisition of land or assets, or the displacement of people is unavoidable under a proposed Sub-project, ensure that the Beneficiary shall, before carrying out the works which would result in such acquisition or displacement, provide to such people, adequate compensation, and other resettlement and rehabilitation benefits, in accordance with the Land Acquisition and Resettlement Framework; and
(d) in the case basis of the physical displacement of persons involving the loss of more than ten percent (10%)of their productive assets or the displacement of more than two hundred (200) people as a result of a Sub- project, ensure thatEnvironmental Management Framework:
(i) a Land Acquisition and Resettlement Action such Environmental Management Plan shall be prepared in accordance with the Land Acquisition and Resettlement requirements of the Environmental Management Framework, disclosed locally and furnished to the Bank as part of the Annual Work Plan; and (ii) the Subproject shall be carried out in accordance with such EnvironmentalManagement Plan as approved by the Bank;
(b) if a Land Acquisition and/or Involuntary Resettlement Plan would be required for approvala Subproject on the basis of the Land Acquisition and Involuntary Resettlement Policy Framework: (i) said Land Acquisition and/ or Involuntary Resettlement Plan shall be prepared in accordance with the requirements of the Land Acquisition and Involuntary Resettlement Policy Framework, disclosed locally and furnished to the Bank as part of the Annual Work Plan; and (ii) no works under a Subproject shall be commenced until (A) all measures required to be taken under said Land Acquisition and/or Resettlement Plan prior to the initiation of said works have been taken; (B) BSIF has prepared and furnished to the Bank a report in form and substancesatisfactory to the Bank, on the status of compliance with the requirements of said Land Acquisition and/or Involuntary Resettlement Plan; and (C) the Bank has confirmed that said works may be commenced; and
(iic) prior to if an Indigenous Peoples Plan would be required for a Subproject on the carrying out basis of the Sub-project, ensure that all Displaced Persons Indigenous Peoples Framework: (i) said Indigenous Peoples Plan shall have been compensated and provided with applicable resettlement and rehabilitation benefits be prepared in accordance with the provisions requirements of such Land Acquisition the Indigenous Peoples Framework, disclosed locally and Resettlement Action furnished to the Bank as part of the Annual Work Plan; and (ii) no worksunder a Subproject shall be commenced until (A) all measures required to be taken under said Indigenous Peoples Plan to address the needs of the Indigenous Peoples in the areas under the Project have been taken; (B) BSIF has prepared and furnished to the Bank a report in form and substance satisfactory to the Bank, on the status of compliance with the requirements of said Indigenous Peoples Plan; and (C) the Bank has confirmed that said work may be commenced.

(ii) SLPs, MEPs, LIPs and Forestry SMEs are screened for involuntary resettlement effects, particularly relating to losses of income, housing, community facilities, and resources that would require compensation to be paid out in accordance with ADB’s Policy on Involuntary Resettlement, and that in the event that any adverse involuntary resettlement effects are found, measures shall be prepared undertaken to address the adverse effects in accordance with the Land Acquisition Borrower’s Manual for Addressing Involuntary Resettlement Impacts and Resettlement FrameworkEthnic Minority Development and the principles and objectives of ADB’s Policy on Involuntary Resettlement, including full disclosure and free access of all relevant documentation to relevant parties and in full consultation of all affected parties;
(iii) contractual arrangements for each SLPs, MEP, LIPs under the LPA shall require that Project activities are carried out in accordance with ADB’s Indigenous Peoples’ Policy and the Ethnic Minorities Development Framework as agreed between the Borrower and ADB, and furnished any Action Plan and any specific plans for Indigenous Peoples, as agreed upon by the Borrower and ADB, and the relevant SLPs, MEP, LIPs shall undertake measures to address any adverse effects resulting from any activity under the Bank Project, in accordance with the principles and objectives of ADB’s Indigenous Peoples’ Policy;
(iv) where appropriate, monitoring and mitigation measures for approvala SLP, MEP, or LIP are undertaken in line with the relevant environmental assessment and in accordance with the principles and objectives of ADB’s Environment Policy;
(v) where environmental and social protection and mitigation measures are recommended for a SLP, MEP, or LIP, the conditions must be set in place for their implementation before any SLP, MEP, or LIP is approved for site development; and
(iivi) prior the public has free and ready access to the carrying out of the Sub-projectenvironmental and relevant Project information produced for SLPs, ensure MEPs, and LIPs that all Displaced Persons shall have been compensated and provided with applicable resettlement and rehabilitation benefits in accordance with the provisions of such Land Acquisition and Resettlement Action Plan.

(b) through a process of informed consultation and participation, involve involving concerned Isolated and Vulnerable People in the design and implementation of Sub-projects so as to ensure that the benefits received by the Isolated and Vulnerable People under the Project are in harmony with their economic, social and cultural preferences, and likely to protect their customary user rights.
3. In carrying out Sub-projects, the Borrower Recipient shall ensure that the provisions of the Environmental Management Framework Guidelines have been complied with and, where applicable, an Environmental Management Plan Guidelines fully consistent with this Agreement and the Environmental Management Framework Guidelines has been prepared and agreed in writing between the Borrower and the Bank upon and applied in the implementation of such Sub-project.
4. 2plan. In carrying out Sub-projects, the Borrower shallshall apply, and shall ensure that each Participating Kelurahan shall apply, the Isolated Vulnerable Peoples Framework to Sub-project implementation, including:
(a) avoidavoiding, and, if not possible, minimize minimizing cultural, social and economic adverse effects on Isolated Vulnerable People, People caused or likely to be caused by the Project, by taking appropriate mitigating measures; and

3. In carrying out Sub-projects, the Borrower shall ensure that the provisions of the Environmental Management Framework Guidelines have been complied with and, where applicable, an Environmental Management Plan fully consistent with this Agreement and the Environmental Management Framework Guidelines has been prepared and agreed upon in writing between the Borrower and the Bank upon Bank, and applied in the implementation of such Sub-project.

Environmental and Social Safeguards. 1. In carrying out Sub-projects, the Borrower Recipient shall:

3. In carrying out Sub-projects, the Borrower Recipient shall ensure that the provisions of the Environmental Management Framework have been complied with and, where applicable, an Environmental Management Plan fully consistent with this Agreement and the Environmental Management Framework has been prepared and agreed in writing between the Borrower Recipient and the World Bank upon and applied in the implementation of such Sub-project.
4. Without limiting the obligations under Section II.A of this Schedule 2, the Recipient shall take all measures necessary on its part to regularly collect, compile, and submit to the World Bank, as part of the Project Reports, (a) information on the status of compliance with the Environmental Management Framework, Land Acquisition and Resettlement Framework, each Land Acquisition and Resettlement Action Plan, and the Isolated and Vulnerable Peoples Framework; (b) giving details of measures taken in furtherance of the Environmental Management Framework and each Land Acquisition and Resettlement Action Plan; and (c) conditions, if any, which interfere or threaten to interfere with the smooth implementation of the Environmental Management Framework and any Land Acquisition and Resettlement Action Plan, and remedial measures taken or required to be taken to address such conditions.
5. In carrying out Sub-projects, the Recipient shall not amend, suspend, repeal or waive, or permit to be amended, suspended, repealed or waived, the Environmental Management Framework or any Land Acquisition and Resettlement Action Plan with the prior written agreement of the World Bank and the Recipient.
6. In the event of any conflict between the provisions of the Environmental Management Framework or any Land Acquisition and Resettlement Action Plan and this Agreement, the latter shall prevail.

2. In carrying out The Borrower, through PMD, shall apply the section of the Implementation Guidelines for Social and Environmental Safeguards in each Sub-projectsProject that may affect Indigenous Peoples, in a manner to ensure that the Borrower Sub-Project shall:
(a) avoid, and, if not possible, minimize cultural, social and economic adverse effects on Isolated Vulnerable PeopleIndigenous Peoples, caused or likely to be caused by the Project, by taking appropriate mitigating measures; and
(b) through a process of free, prior and informed participation, involve concerned Isolated Vulnerable People Indigenous Peoples in the design and implementation of Sub-Sub- projects in which such people reside or make their living and design and implement measures so as to ensure that the benefits received by the Isolated Vulnerable People Indigenous Peoples under the Project are in harmony with their economic, social and cultural preferences, and likely to protect their customary user rightsrights and reduce, mitigate and offset any adverse impacts of Sub-projects.
3. In carrying out The Borrower, through PMD, shall ensure that the proceeds of Kecamatan Grants shall not be used to finance the acquisition of land or compensation for involuntary resettlement and that no Sub-projectsProject shall require or permit the involuntary acquisition of land or involuntary resettlement. The Borrower, through PMD, shall ensure that in any Sub-Project involving land donation, the planning and verification procedures for land donation (voluntary donation and donation with compensation) set out in the Implementation Guidelines for Social and Environmental Safeguards shall have been followed and documented in a manner satisfactory to the Bank and PMD prior to the commencement of the Sub-Project.
4. The Borrower shall ensure that the provisions proceeds of the Environmental Management Framework have been complied with andLoan are not used to finance any activities or materials on the Negative List as set out in Section A.2 of Annex 1 to this Schedule 2.
5. Without limiting the obligations under Section II.A of this Schedule 2, where applicable, an Environmental Management Plan fully consistent with this Agreement and the Environmental Management Framework has been prepared and agreed in writing between the Borrower shall include in each Project Report: (a) information on the status of compliance with the Implementation Guidelines for Social and the Bank upon and applied Environmental Safeguards; (b) details of measures taken for each Sub-Project in the implementation of such guidelines; (c) conditions, if any, in any Sub-projectProject which interfere or threaten to interfere with the implementation of such guidelines; and (d) remedial measures taken or required to be taken to address such conditions.
