Environmental and Social Safeguards. (a) The Recipient shall carry out the Project in accordance with the provisions of the ESMF, RPF, IPM and any ESMPs and RAPs. (b) If any activities included in an Annual Work Plan would, pursuant to the ESMF, require the adoption of an ESMP, the Recipient shall ensure that no such activities shall be implemented unless and until an ESMP for such activities: (i) is prepared, in accordance with the ESMF and furnished to the Association for review and approval; and (ii) is disclosed as required by the ESMF; and (c) If a RAP would be required for any activities included in an Annual Work Plan on the basis of the RPF, the Recipient shall ensure that: (i) said RAP has been prepared in accordance with the requirements of the RPF, disclosed locally and furnished to the Association as part of the proposed Annual Work Plan; and (ii) that no such activities shall commence until: (A) all measures required to be taken under said RAP prior to the initiation of said activities have been taken; (B) a report, in form and substance satisfactory to the Association, on the status of compliance with the requirements of said RAP has been prepared and furnished to the Association; and (C) the Association has confirmed that said activities may be commenced. 2. Without limitation upon its other reporting obligations under this Agreement, the Recipient shall, in accordance with terms of reference satisfactory to the Association: (a) monitor the status of compliance with the ESMF, IPM, RPF, and all ESMPs and RAPs; and (b) prepare and furnish to the Association, as part of each Project Report, a report on the results of such monitoring activities during the period covered by said Project Report, giving details of: (i) measures taken in furtherance of such ESMF, RPF, IPM, ESMPs and RAPs; (ii) conditions, if any, which interfere or threaten to interfere with the smooth implementation of such ESMF, RPF, IPM, ESMPs and RAPs; and (iii) remedial measures taken or required to be taken to address such conditions. 3. The Recipient shall afford the Association a reasonable opportunity to review the reports prepared under paragraph 2 of this Part D, and thereafter shall carry out with due diligence all remedial measures agreed with the Association so as to ensure the proper implementation of the Project in accordance with the ESMF, RPF, IPM and any RAPs and ESMPs.

2. Without (b) without limitation upon its other reporting obligations under the provisions of paragraph E(a) of this AgreementSection, when applicable, the Recipient shall, shall prepare and implement Resettlement Action Plans in accordance with terms of reference satisfactory to the Association: (a) monitor the status of compliance with the ESMF, IPM, RPF, in form and all ESMPs and RAPs; and (b) prepare and furnish substance acceptable to the Association, defining a program of actions, measures and policies for compensation and resettlement of Affected Persons, as part a result of each Project Reportthe carrying out of the Project, a report including the magnitude of displacement, proposed compensation and resettlement arrangements, budget and cost estimates, and sources of funding, together with adequate institutional, monitoring and reporting arrangements capable of ensuring proper implementation of, and regular feedback on the results of such monitoring activities during the period covered by compliance with said Project Report, giving details of:
(i) measures taken in furtherance of such ESMF, RPF, IPM, ESMPs and RAPsResettlement Action Plans;
(iic) conditionswithout limitation upon the provisions of paragraph E(a) of this Section, if anywhen applicable, which interfere or threaten to interfere with the smooth implementation of such ESMF, RPF, IPM, ESMPs and RAPs; and
(iii) remedial measures taken or required to be taken to address such conditions.
3. The Recipient shall afford the Association a reasonable opportunity to review the reports prepared under paragraph 2 of this Part D, prepare and thereafter shall carry out with due diligence all remedial measures agreed with the Association so as to ensure the proper implementation of the Project implement Environmental Management Plans in accordance with the ESMF, in form and substance acceptable to the Association, defining a program of actions, measures and policies to avoid, minimize, mitigate, and offset potential adverse environmental and social impacts, as a result of the carrying out of the Project, together with adequate institutional, monitoring and reporting arrangements capable of ensuring proper implementation of, and regular feedback on compliance with said Environmental Management Plans;
(d) furnish to the Association any revisions proposed to be introduced into the RPF and/or ESMF in order to achieve their objectives and, thereafter, introduce such revisions into such frameworks as shall have been agreed with the Association;
(e) except as the Recipient and the Association may otherwise agree in writing, the Recipient shall not abrogate, amend, repeal, suspend, waive or otherwise fail to enforce the provisions of the ESMF, and the RPF; and
(f) in case of any conflict between the terms of the ESMF, IPM the RPF and any RAPs and ESMPsthose of this Agreement, the terms of this Agreement shall prevail.

Environmental and Social Safeguards. (a) 1. The Recipient shall carry out the Project in accordance with the: (i) Guidelines for Handling and Disposal of Medical Waste; (ii) Guidelines for Malaria Vector Control; and (iii) Guidelines for Indoor Residual Insecticide Spraying.
2. The Recipient shall:
(a) ensure that the provisions pilot LIG component under Part 1(ii) of the Project is carried out in accordance with the Environmental and Social Management Framework (ESMF, ) and the Resettlement Policy Framework (RPF, IPM and any ESMPs and RAPs) prepared for the purposes of the construction of small- scale civil works under Subprogram A(ii).
(b) If in cases of any activities included in an Annual Work Plan would, pursuant activity to be undertaken under a Local Investment Grant under Part 1(ii) of the ESMF, require Project requiring the adoption of an ESMP, the Recipient shall ensure that no such activities shall be implemented unless and until an ESMP for such activities: EMP or RAP,
(i) is preparedproceed to have such EMP or RAP, as the case may be:
(A) prepared in accordance with the ESMF and furnished to or RPF, as the Association for review and approval; case may be, and (iiB) is disclosed as required thereafter adopted by the ESMFrelevant Local or other authority, prior to implementation of the activity; and
(ii) thereafter take such measures as shall be necessary or appropriate to enable the Local Authority or other authority to comply with the requirements of such EMP or RAP, as the case may be.
(c) If a in the case of any Resettlement Activity involving Project Affected Persons, ensure that no displacement, loss, or restriction of access shall occur before necessary resettlement measures consistent with the RPF and RAP would be are in place, including full payment to Project Affected Persons of compensation and of other assistance required for any activities included in an Annual Work Plan on the basis of the RPF, the Recipient shall ensure that: (i) said RAP has been prepared in accordance with the requirements RPF.
3. Without limitation upon its other reporting obligations under this Agreement, the Recipient shall, beginning no later than 3 months after the effectiveness of the RPFthis Agreement, disclosed locally regularly collect, compile and furnished submit to the Association as part of the proposed Annual Work Plan; and (ii) that no such activities shall commence until: (A) all measures required to be taken under said RAP prior to the initiation of said activities have been taken; (B) a reportAssociation, on an annual basis, reports in form and substance satisfactory to the Association, on the status of compliance with the requirements of said RAP has been prepared and furnished to the Association; and (C) the Association has confirmed that said activities may be commenced.
2. Without limitation upon its other reporting obligations under this Agreement, the Recipient shall, in accordance with terms of reference satisfactory to the Association: (a) monitor the status of compliance with the ESMF, IPM, RPF, and all ESMPs EMPs and RAPs; and (b) prepare and furnish to the Association, as part of each Project Report, a report on the results of such monitoring activities during the period covered by said Project Reportif any, giving details of:
(ia) measures taken in furtherance of such ESMF, RPF, IPM, ESMPs and EMPs and RAPs, if any;
(iib) conditions, if any, which interfere or threaten to interfere with the smooth implementation of such ESMF, RPF, IPM, ESMPs and EMPs and RAPs, if any; and
(iiic) remedial measures taken or required to be taken to address such conditions.
3. The Recipient shall afford the Association a reasonable opportunity to review the reports prepared under paragraph 2 of this Part D, and thereafter shall carry out with due diligence all remedial measures agreed with the Association so as to ensure the proper implementation of the Project in accordance with the ESMF, RPF, IPM and any RAPs and ESMPs.

Environmental and Social Safeguards. 1. The Borrower shall ensure that the energy efficiency and renewable energy investments (aSubprojects) The Recipient shall carry out financed through the Line of Credit under Part B.4 of the Project are carried out in accordance with the provisions Environmental Management Framework (EMF), and the Resettlement Policy Framework (RPF), respectively, including the guidelines, rules and procedures defined in said EMF and RPF. (ca) If a RAP if an environmental management plan or similar safeguard instrument would be required for any activities included in an Annual Work Plan a Subproject on the basis of the RPF, the Recipient shall ensure thatEMF: (i) said RAP has been such environmental management plan or similar safeguard instrument shall be prepared in accordance with the requirements of the RPFEMF, disclosed locally and furnished to the Association as part of the proposed Annual Work PlanBank for approval; and (ii) that the energy efficiency Subproject shall be carried out in accordance with such environmental management plan or similar safeguard instrument as approved by the Bank;
(b) if a resettlement action plan would be required for a Subproject on the basis of the Resettlement Policy Framework: (i) said resettlement action plan shall be prepared in accordance with the requirements of the Resettlement Policy Framework, disclosed locally and furnished to the Bank for approval; and (ii) no such activities works under a Subproject shall commence until: until (A) all measures required to be taken under said RAP resettlement action plan prior to the initiation of said activities works have been taken; (B) the Development Bank of Jamaica has received from the responsible AFI and furnished to the Bank a report, report in form and substance satisfactory to the AssociationBank, on the status of compliance with the requirements of said RAP has been prepared and furnished to the Associationresettlement action plan; and (C) the Association Bank has confirmed that said activities works may be commencedcommence.
2. The Borrower shall cause the Development Bank of Jamaica to ensure that all measures required for carrying out any environmental management plan or similar safeguard instrument, and any resettlement action plan are taken in a timely manner.
3. Without limitation upon to its other reporting obligations under this Agreementagreement and under Section 5.08 of the General Conditions, the Recipient shallBorrower shall cause the Development Bank of Jamaica to include in the Project Reports referred to in Section II.A of this Schedule adequate information on the implementation of the EMF, in accordance with terms of reference satisfactory to the Association: (a) monitor the status of compliance with the ESMF, IPM, RPF, any environmental management plan or similar safeguard instrument, and all ESMPs and RAPs; and (b) prepare and furnish to the Association, as part of each Project Report, a report on the results of such monitoring activities during the period covered by said Project Reportany resettlement action plan, giving details of:
(ia) measures taken in furtherance of such ESMFthe EMF, the RPF, IPMany environmental management plan or similar safeguard instrument, ESMPs and RAPsany resettlement action plan;
(iib) conditions, if any, which interfere or threaten to interfere with the smooth implementation of such ESMFthe EMF, the RPF, IPMany environmental management plan or similar safeguard instrument, ESMPs and RAPsany resettlement action plan; and
(iiic) remedial measures taken or required to be taken to address such conditions.
3. The Recipient shall afford the Association a reasonable opportunity to review the reports prepared under paragraph 2 of this Part D, conditions and thereafter shall carry out with due diligence all remedial measures agreed with the Association so as to ensure the proper continued efficient and effective implementation of the Project in accordance with EMF, the ESMF, RPF, IPM any environmental management plan or similar safeguard instrument, and any RAPs and ESMPsresettlement action plan.

(ca) If a RAP if an additional environmental and/ or pest management plan, would be required for any activities included in a Subproject or an Annual Work Plan activity on the basis of the RPF, the Recipient shall ensure thatEAMP: (i) said RAP has been such environmental and/or pest management plan shall be prepared in accordance with the requirements of the RPFEAMP, disclosed locally and furnished to the Association World Bank as part of the proposed Annual Work Plan; and (ii) that the Subproject or the activity shall be carried out in accordance with such environmental management plan and/or pest management plan as approved by the World Bank; and
(b) if a Subproject would otherwise restrict access to a resource or area: (i) such Subproject shall be prepared on the basis of the procedures set forth in the RPF, as part of the Annual Work Plan; and (ii) no such activities works under a sustainable land and water management activity or Subproject shall commence be commenced until: (A) all measures required to be taken under said RAP RPF procedures prior to the initiation of said activities works have been taken; (B) the Recipient has prepared and furnished to the World Bank a report, report in form and substance satisfactory to the AssociationWorld Bank, on the status of compliance with the requirements of said RAP has been prepared and furnished to procedures under the AssociationRPF; and (C) the Association World Bank has confirmed that said activities works may be commenced.
2. The Recipient shall ensure that all measures required for carrying out the recommendations of the Safeguard Instruments are taken in a timely manner.
3. Without limitation upon to its other reporting obligations under this Agreementagreement and under Section 2.06 of the Standard Conditions, the Recipient shall, shall include in accordance with terms the Project Reports referred to in Section II.A of reference satisfactory to the Association: (a) monitor the status of compliance with the ESMF, IPM, RPF, and all ESMPs and RAPs; and (b) prepare and furnish to the Association, as part of each Project Report, a report this Schedule adequate information on the results implementation of such monitoring activities during the period covered by said Project ReportSafeguard Instruments, giving details of:
(ia) measures taken in furtherance of such ESMF, RPF, IPM, ESMPs and RAPsSafeguard Instruments;
(iib) conditions, if any, which interfere or threaten to interfere with the smooth implementation of such ESMF, RPF, IPM, ESMPs and RAPsSafeguard Instruments; and
(iiic) remedial measures taken or required to be taken to address such conditions.
3conditions and to ensure the continued efficient and effective implementation of such Safeguard Instruments. The Recipient shall afford the Association World Bank a reasonable opportunity to review the reports prepared under paragraph 2 of this Part D, and thereafter shall carry out with due diligence all remedial measures agreed exchange views with the Association so as Recipient on such reports. Each such report shall be furnished to ensure the proper implementation World Bank not later than one month after the end of the Project six months covered by such report and the first such report shall be furnished to the World Bank not later than one month after the end of the six months in accordance with which the ESMF, RPF, IPM and any RAPs and ESMPsworks under the first Subproject commenced.
