Common use of Environmental Compliance Program Clause in Contracts

Environmental Compliance Program. Tenant shall establish and thereafter observe and maintain a written program to facilitate such compliance in accordance with the requirements set forth in Section 104.6., which program shall be referred to as the “Environmental Compliance Program” or “ECP.” The ECP shall be prepared by Tenant and submitted to the Director of the Harbor Department’s Environmental Management Division. The Harbor Department’s review and approval of such ECP shall not relieve Tenant of its obligations pursuant to this Subsection 104.6.
