Environmental Controls. Full compensation for conforming to the requirements of this Section shall be considered as included in the prices paid for the various contract items of Work involved and no additional compensation will be allowed.
Environmental Controls. The contractor acknowledges the importance of environmental sensitivity and agrees to conform to all environmental controls specified in this document and as revised from time to time. These controls form part of the EMP for the development and are required to be legally enforced. Presently, these specifications include the following considerations.
Environmental Controls. Each Data Center is equipped to provide redundant external electrical power sources, redundant uninterruptible power supplies, backup generator power, and redundant temperature and humidity controls.
Environmental Controls. (1) The Mobile Retardant Base site will be at least 300 feet from any waterway, including seasonal lakes or streams, if water is present.
(2) Site Spill containment plan. The Contractor and the Agency Representative at the incident will jointly develop a Site Spill Management Plan.
(3) The Retardant Contractor will be responsible for the removal and disposal of chemical residue and chemical spills created in the retardant mixing area or due to accident or negligence of retardant personnel. All clean-up and disposal will be accomplished in accordance with state and federal environmental regulations.
(4) Spills that result from Aircraft companies, Agency personnel, other Agency Contractors, or natural disaster will not be the Retardant Contractors responsibility. The Retardant Contractor shall assist in the clean-up efforts and may charge the Government for additional material cost, other than labor, incurred to support the clean-up.
(5) All wash-down water generated from cleaning aircraft and ramp surfaces shall be the ordering Agency’s responsibility for disposal.
(6) At the close of a Mobile Retardant Base Contract, unused mixed retardant and wash- down water created from retardant equipment clean-up is the responsibility of the Agency.
(7) At locations where waste water collection and/or containment are shared by Contractor and agency, disposal costs may be pro-rated based on estimated gallons generated by the Government or contractor.
(8) All chemical spills into waterways or other identified avoidance areas will be reported to the Incident Commander, through the on-site agency representative and to the onsite agency representative and Wildland Fire Chemical Systems (000) 000-0000 within 24 hours of the time of the spill.
Environmental Controls. If environmental conditions could reasonably be expected to have an adverse effect on product quality, the Supplier shall establish and maintain procedures, including maintenance, adjustment, and inspection to adequately control these environmental conditions. The Supplier shall keep records of these activities and make them available to the Purchaser upon request.

It should also be noted that these controls form part of the development and are required to be legally enforced.

6.14.2.2 Until the permanent HVAC system is complete and available for use:
.1 the Contractor shall make arrangements and pay for installation and maintenance of temporary heating and ventilating systems; and

.2 The CM shall pay the costs incurred in operating the temporary heating and ventilating systems.
6.12.2.3 When the permanent HVAC system is complete and available for use:
.1 The CM shall start up and maintain operation of the permanent HVAC system, including filters, and promptly remove temporary heating and ventilating systems.
.2 If the Project consists entirely of new construction, the CM shall pay the costs of energy consumed in operating the permanent HVAC system until Substantial Completion.
.3 If the Project is a renovation of an existing building or structure, addition(s) to an existing building or structure, or any combination of new construction and renovation work that does not allow separate metering of utilities, the Owner shall pay the costs of energy consumed in operating the permanent HVAC system.
6.12.2.4 From the date of Substantial Completion, the Owner shall pay the cost of operating the permanent HVAC system for the occupied portion of the Project.
6.12.2.5 If the permanent HVAC system is used during construction, the CM shall furnish an extended warranty and service contract in effect until the expiration of the Correction Period.

.1 The DB shall start up and maintain operation of the permanent HVAC system, including filters, and promptly remove temporary heating and ventilating systems.
.2 If the Project consists entirely of new construction, the DB shall pay the costs of energy consumed in operating the permanent HVAC system until Substantial Completion.

6.13.2.4 From the date of Substantial Completion, the Owner shall pay the cost of operating the permanent HVAC system for the occupied portion of the Project.
6.13.2.5 If the permanent HVAC system is used during construction, the DB shall furnish an extended warranty and service contract in effect until the expiration of the Correction Period.
Environmental Controls. Requirements aimed at the protection of the watercourse and existing treed buffer are included in the development agreement and further reinforced on the landscape plan. The agreement includes requirements to ensure the development, including all servicing considerations such as storm water management and any element having possible impact on the adjacent watercourse and buffer, comply with all applicable by-laws, standards, policies, and regulations of the Municipality and other approval agencies. Staff have reviewed the proposal in terms of all relevant policy criteria and advise that it is reasonably consistent with the intent of the MPS. The size and use the building, incorporation of quality materials, and provision of adequate parking are in keeping with and complement the surrounding commercial uses. The landscaping plan provides for attractive site greening as well as buffering, screening and preservation of the adjacent watercourse buffer. Therefore, staff recommend that the North West Community Council approve the proposed development agreement as contained in Attachment A.
