AIR POLLUTION CONTROL. Contractor shall comply with all air pollution control rules, regulations, ordinances and statutes which apply to any work performed pursuant to the Contract, including rules promulgated by the Bay Area Air Quality Management District, the California Department of Public Health or any other applicable agency. In the absence of any applicable air pollution control rules, regulations, ordinances or statutes governing solvents, all solvents, including but not limited to the solvent portions of paint thinners, curing compounds, parts cleaners and degreasers and liquid asphalt used on the Project shall comply with the applicable material requirements of the Bay Area Air Quality Management District. All containers of paint thinner, curing compound parts cleaners and degreasers or liquid asphalt shall be labeled to indicate that the contents fully comply with said requirements. Material to be disposed of shall not be disposed of onsite (i.e. used up inappropriately or burned). Compressed gases contained within cylinders or aerosol cans shall never be released for any purpose other than that intended by the manufacturer.

AIR POLLUTION CONTROL. Prior to commencing the Work, if applicable, the Contractor shall obtain a permit from the Xxxxx County Department of Air Quality and Environmental Management. The Contractor shall perform the Work in a manner that does not discharge smoke, dust, or other air contaminants into the atmosphere from any source whatsoever, in violation of the laws, rules, and regulations of federal, state, and local government pertaining to air pollution including, but not necessarily limited to, the following: i. Nevada Revised Statute 445: Air Quality Regulations ii. Title 40 Code of Federal Regulations (CFR) Part 82 Protection of Stratospheric Ozone – Refrigerant Regulations iii. Adhering to all Xxxxx County Department of Air Quality and Environmental Management regulations. iv. Any emissions from the Contractor’s activities that might cause nuisance to persons either onsite or offsite from emission from the Contractors activities. The Contractor shall not be granted any time extensions for delays due to compliance with or violations of the aforementioned laws, rules, or regulations; and shall pay all compliance costs and violation fines and penalties. Such imposed fines and penalties shall not result in an increase in the Contract Amount, and are not subject to reimbursement by the Owner.
AIR POLLUTION CONTROL. The Licensee shall comply with all air pollution control rules, regulations, ordinances and statutes that apply to the Work performed under the Contract, including any air pollution control rules, regulations, ordinances and statutes adopted under the authority of section 11017 of the Government Code. The Licensee must be eligible to perform work for the State, and is deemed eligible if not found to be in violation of any order, resolution, or regulation relating to air or water pollution adopted in accordance with Government Code section 4477.
AIR POLLUTION CONTROL. Design Build Entity and each Subcontractor shall comply with all State and/or local air pollution control rules, regulations, ordinances, and statutes that apply to any Work performed on the Project. If there is a conflict between the State and local air pollution control rules, regulations, ordinances, and statutes, the most stringent shall govern.

All containers of paint, thinner, curing compound or liquid asphalt shall be labeled to indicate that the contents fully comply with said requirements. Material to be disposed of shall not be burned.

If there is a conflict between the Bay Area Air Pollution Control District rules, regulations, ordinances, and statutes and the rules, regulations, ordinances, and statutes of other regulatory agencies, the most stringent shall govern.
