Common use of Environmental Engineering Firm Clause in Contracts

Environmental Engineering Firm. No environmental engineering firm which prepared Phase I environmental assessment reports (or other similar reports) with respect to the Resorts as set forth in the Registration Statement was employed for such purpose on a contingent basis or has any substantial interest in the Company or any of the Affiliated Companies or the Related Partnerships.

Environmental Engineering Firm. No environmental engineering firm which prepared Phase I environmental assessment reports (or other similar reports) with respect to the Resorts as set forth in the Registration Statement was employed for such purpose on a contingent basis or has any substantial interest in the Company or any of the Affiliated Companies or the Related Partnershipsits subsidiaries.

No environmental engineering firm which 20 prepared Phase I I, Phase II or Phase III environmental assessment reports (or other similar reports) with respect to the Resorts as set forth in the Registration Statement was employed for such purpose on a contingent basis or or, has any substantial interest in the Company or any of the its Subsidiaries, Affiliated Companies or the Related Partnerships.

Environmental Engineering Firm. No environmental engineering firm which prepared Phase I environmental assessment reports (or other similar reports) with respect to the Resorts as set forth in the Registration Statement was employed for such purpose on a contingent basis or has any substantial interest in the Company or any of the Affiliated Companies or the Related Partnershipsits Subsidiaries.
