Common use of Environmental Measures Clause in Contracts

Environmental Measures. a. The Concessionaire shall take all reasonable steps to protect the environment (both on and off the Project Site) and to limit damage and nuisance to people and property resulting from construction operations. b. The Concessionaire shall ensure that surface discharges and effluent from the Project Site during the Concession Period shall not exceed the permissible limits as prescribed by law. c. The Concessionaire shall be liable for and shall indemnify, protect, defend and hold harmless the Authority, it's officers, employees and agents from and against any and all demands, claims, suits and causes of action and any and all liability, costs, expenses, settlements and judgments arising out of the failure of the Concessionaire to discharge its obligations under this Article and to comply with the provisions of health, safety and environmental laws as applicable.

The Concessionaire shall dispose off the waste/garbage as per the Applicable Laws and ensure that surface discharges and effluent from the users do not litter in an around the Project Site during the Concession Period shall not exceed the permissible limits as prescribed by lawSite. c.
