Common use of ENVIRONMENTAL PROTECTION STANDARDS Clause in Contracts

ENVIRONMENTAL PROTECTION STANDARDS. 6 CONTRACTOR shall be in compliance with Section 306 of the Clean Air Act 7 [Title 42 USC Section 1857(h)], Section 508 of the Clean Water Act (Title 33 8 USC Section 1368), Executive Order 11738 and Environmental Protection Agency, 9 hereinafter referred to as "EPA," regulations (Title 40 CFR Part 15), as any 10 may now exist or be hereafter amended. Under these laws and regulations, 11 CONTRACTOR assures that: 12 40.1 No facility to be utilized in the performance of the proposed 13 grant has been listed on the EPA List of Violating Facilities; 14 40.2 It will notify COUNTY prior to award of the receipt of any 15 communication from the Director, Office of Federal Activities, U.S. EPA, 16 indicating that a facility to be utilized for the grant is under consideration 17 to be listed on the EPA List of Violating Facilities; and 18 40.3 It will notify COUNTY and the EPA about any known violation of the 19 above laws and regulations.
