Equal treatment under the Federal Constitution. In 1962, the Federal Tribunal held that the source taxa- tion procedure of the Canton of St. Gallen violated the constitutional principle of equal treatment.57 The Court stated that the procedure treated, without any objective reasons, foreign nationals who were resident but did not hold a permanent residence permit differently from both foreign nationals with a permanent residence per- mit and resident Swiss nationals. It was noted that the purpose of the source taxation procedure is the facilita- tion of taxation of individuals who stay only for a brief duration in the canton. The Court, however, held that such a purpose could not justify the different tax treat- ment. It was emphasized that difficulties could arise from the brief duration of presence in the Canton, but not from the lack of a residence permit. The Court argued that an objective reason for the application of a source taxation procedure could be lack of residence in the Canton. Finally, the Court concluded that resident foreign nationals without a permanent residence permit were in the same position as resident foreign nationals with a permanent residence permit and resident Swiss nationals.58 Three years later, the Federal Tribunal confirmed its pre- vious ruling insofar as the source taxation procedure of the Canton of Aargau constituted unequal treatment.59 The Court, however, reconsidered the justification argu- ment. In this case, the Court held that the tax adminis- tration could not always clarify the question of residence of foreign employees. In 1964, approximately 720,900 frontier workers and foreign employees without a per- manent residence permit worked in Switzerland. The Court noted that there was an increasing number of for- eign employees who left Switzerland without paying taxes. It was concluded that the unequal treatment was March 2006, Federal Journal 2006, p. 5167. The amending protocol entered into force on 2 February 2007 and, in general, applies with retroactive effect from 1 January 2006.

The requirements of Section 6002 include: (1) procuring only items designated in guidelines of the Environmental Protection Agency (EPA) at 40 CFR part 247 that contain the highest percentage of recovered materials practicable, consistent with maintaining a satisfactory level of competition, where the purchase price of the item exceeds $10,000 or the value of the quantity acquired during the preceding fiscal year exceeded $10,000; (2) procuring solid waste management services in a manner that maximizes energy and resource recovery; and establishing an affirmative procurement program for procurement of recovered materials identified in the EPA guidelines. Does vendor certify that it is in compliance with these provisions? Yes If the Federal award meets the definition of “funding agreement” under 37 CFR §401.2 (a) and the recipient or subrecipient wishes to enter into a contract with a small business firm or nonprofit organization regarding the substitution of parties, assignment or performance of experimental, developmental, or research work under that “funding agreement,” the recipient or subrecipient must comply with the requirements of 37 CFR Part 401, “Rights to Inventions Made by Nonprofit Organizations and Small Business Firms Under Government Grants, Contracts and Cooperative Agreements,” and any implementing regulations issued by the awarding agency.
