Common use of Equipment and Parts Warranty Clause in Contracts

Equipment and Parts Warranty. Unless otherwise stated in the Agreement, Miraclon warrants for the periods set forth below (“Warranty Period”) as follows: Equipment shall be free from material defects in materials and workmanship, subject to normal use and recommended service, for the warranty period set forth in the Schedule Equipment, Software and Professional Services. If no such period is specified, the warranty shall be for a period that is the shorter of (i) 12 months from the date of Completion of Installation of Equipment, and (ii) 14 months from the date of initial Delivery by Miraclon. Parts shall be free from material defects in materials and workmanship for a period of 12 months from Delivery. Miraclon specifically does not warrant that the Equipment or Customer’s configuration will operate uninterrupted or error free.
