Common use of ERRORS AND OMMISSIONS Clause in Contracts

ERRORS AND OMMISSIONS. 6.14.1 All Projects/Services submitted by XXXX shall be complete and shall be carefully checked prior to submission. XXXX understands that Owner's checking is discretionary, and XXXX shall not assume that Owner will discover errors and/or omissions. If Owner discovers any errors or omissions prior to approving XXXX'x Projects/Services, the Projects/Services will be returned to XXXX for correction. Should Owner or others discover errors or omissions in the work submitted by XXXX after Owner's approval thereof, Owner's approval of XXXX'x Projects/Services shall not be used as a defense by XXXX. 6.14.2 If XXXX subcontracts portions of the architectural or engineering design Projects/Services to be performed under the terms of this Contract, XXXX shall obtain evidence that such subcontractors have purchased Professional Liability Insurance to the same limits as described in Paragraph 6.15.4 and containing the same clauses as the insurance required of XXXX under the terms of this Contract. Evidence of subcontractor's insurance shall be submitted to Owner upon request.
