Common use of ESCROW / CLOSING AGENT Clause in Contracts

ESCROW / CLOSING AGENT. The Escrow Agent / Closing Agent for purposes of this Contract shall be Xxxxx X. Xxxxxxx of Xxxxxxx & Xxxxxxxx, LLC d/b/a Attorney's Title Company, Concordia, Kansas. The Escrow Agent shall hold the executed Trustees' Deed, Trust Certification, Warranty Deed, a copy of the Title Insurance Commitment, and a copy of this Contract until such time as the Contract is paid in full or until such time as the Escrow Agent receives instructions to do otherwise by the parties hereto. All payments shall be made directly to the Escrow Agent, who shall then deposit each payment to the account of Seller or as Seller may direct. The xxxxxxx money shall be held by the Escrow Agent in its non-interest bearing trust account. Notwithstanding any other terms of this Contract providing for forfeiture or refund of the xxxxxxx money deposit, the parties hereto understand that applicable Kansas Real Estate Law prohibits the Escrow Agent from disbursing the xxxxxxx money, once deposited, unless:
