ESTABLISHMENT OR ELIMINATION OF A POSITION. 13.1 Establishment of New Position When any new position is established during the lifetime of this Agreement, that is not covered by Appendix “A”, and is within the scope of the recognition clause, the position shall be evaluated under the existing classification system. In the event the results of the evaluation fall outside of the existing classification levels in this Agreement, the rate of pay shall be subject to negotiation between the Union and the Negotiation Committee established pursuant to the Health Services Act. If the parties are unable to agree on the rate of pay of the job in question, such dispute shall be submitted to arbitration. The new rate shall become retroactive to the time the position was first filled by the Employee.
