ETHICS IN CONTRACTING. 24.1. Prohibition against Contracting with Predatory or High Cost Lenders. By execution of this Agreement, Service Provider, or its authorized agent, certifies, under penalty of perjury, that this Agreement is made by a person or business entity that is neither a predatory lender nor a high cost lender, nor is Service Provider an Affiliate of a predatory lender or a high cost lender, as defined by City Code of Ordinances §58-102. The undersigned Service Provider, or authorized agent, further certifies that he/she is an agent duly authorized to sign this certification on behalf of the Service Provider.
ETHICS IN CONTRACTING. Service Provider will comply with the Authority’s Procurement Ethics Policy (available on the Authority’s Website or upon request), and shall execute an Ethics in Contracting Form, attached hereto as Appendix F.

ETHICS IN CONTRACTING. 16.01 Because DWIHN is a community mental health services program established under Sections 204 and 205 of the Michigan Mental Health Code, the Contractor must comply with DWIHN’s Procurement Policy and the Procurement Ethic’s Policy. 16.02 Contractor’s material misrepresentation or delinquency in the disclosures required by DWIHN’s Procurement Policy or the Procurement Ethic’s Policy will be considered a material breach. . 16.03 If DWIHN determines that the Contractor has made a material misrepresentation or is willfully delinquent or knowingly evasive in the disclosures required by the Procurement Ethics Policy, may be debarred by the Purchasing Director, pursuant to DWIHN’s Debarment and Suspension Policy, from competing for any further DWIHN contracts for up to three (3) years. 16.04 If the Contract price is in excess of $20,000.00 and the Contractor knowingly collaborates in or induces a violation of any of the ethical standards that are set forth in DWIHN’s Procurement Ethics Policy, DWIHN has the right to impose any one or more of the following sanctions: A. Immediately terminate the Contract and require the Contractor to pay DWIHN liquidated damages, and not a penalty of 15% of the total Contract compensation; X. Xxxxx or suspend the Contractor from consideration form competing for further DWIHN contracts; or C. Recover the value transferred or received in breach of the ethical standards by a DWIHN employee or other person.
