Fraud and Misrepresentation. If You or Your executors, administrators, Nominees or any other Proper claimant obtains any sum payable under this policy through fraudulent means or devices, all Benefits paid under this policy shall be forfeited and must be immediately repaid. This policy will be terminated immediately and there will be no refund of Premiums. We shall have no liability in respect of such claims and shall be entitled to recover any payment made prior to the discovery of the fraud or misrepresentation.
Fraud and Misrepresentation. Pursuant to Section 2-8.4.1 of the Code of Miami-Dade County, any individual, corporation, or other entity that attempts to meet its contractual obligations with the County through fraud, misrepresentation, or material misstatement, may be debarred. The County, as a further sanction, may terminate or cancel any other contracts with such individual, corporation, or entity. Such individual or entity shall be responsible for all direct or indirect costs associated with termination or cancellation, including attorney’s fees.

Any written or oral information provided by Service Provider, directly or indirectly related to the performance of the services required by this Agreement, constitutes material representations upon which the City relies for the requirements of the Agreement and compliance with local, state and federal laws, rules and regulations. Service Provider agrees to notify the City immediately of any information provided to the City that it knows and/or believes to be false and/or erroneous and immediately provide correct information to the City and take corrective action. Service Provider further agrees to notify the City immediately of any actions or information that it believes would constitute fraud or misrepresentation to the City in performance of this Agreement, whether or not such information actually constitutes fraud and/or misrepresentations, by contacting the Integrity Line 0-000-000-0000. Service Provider agrees to place signage provided by the City regarding the Integrity Line at the location to which Service Provider employees report to perform the services required by this Agreement. Service Provider acknowledges and agrees that a finding of fraud or other impropriety on the part of Service Provider or any Service Provider Personnel may result in suspension or debarment of Service Provider; and the City may pursue any other actions or remedies that the City may deem appropriate. If it is found that Xxxxxx has failed to report changes in circumstances, or has misrepresented to CDA the facts upon which rent is based, so that the rent being paid is less than Tenant should have been paying, then the increase in rent shall be made retroactive in accordance with Section 9D(3). Misrepresentation to CDA or failure to report such changes may also result in termination of this lease and may subject Tenant to penalties available under state or Federal law, which may include imprisonment and/or fines.

If Group, any Member, or any other person seeking coverage on behalf of a Member commits an act, practice, or omission that constitutes fraud or intentional misrepresentation of material fact on the enrollment form for Group or any Member, or in other information provided to HDS regarding the HDS Plan, or the Contract, or in any claim for benefits, then HDS reserves all of its rights and remedies provided by applicable law, including but not limited to the right to immediately terminate the coverage of such person or Group and obtain reimbursement in full from such person or Group for all claims paid by HDS and for all other damages, interest, attorneys' fees and costs incurred by HDS. This includes, but is not limited to, fraudulent requests to enroll in the HDS Plan any person who is not an Eligible Person under the Contract, intentional continuation of the enrollment of any person who is no longer an Eligible Person, or fraudulent use of any HDS membership identification number.

3. HDS will provide written notice of termination due to fraud or intentional misrepresentation to Group or directly to the Subscriber or Member as appropriate.
