Exception to Overtime Provision. (a) Notwithstanding any of the provisions in this Article, overtime does not apply to Clinical Therapists in classification Group C and all classification Group B, consisting of but not limited to Community Health Workers, Community Outreach Worker, Public Health Nutritionists, Research & Statistical Officers, Detox Team Leaders, Treatment Team Leaders and Program Administration Officers who shall be granted straight time off in lieu of authorized overtime to be taken at a mutually agreed time. (b) Where operational requirements do not permit an employee who is excluded from overtime entitlement under Article 16.01(a) to be granted time-off with pay in lieu of overtime hours worked within a twelve (12) month period, he/she shall be entitled to receive compensation for such accumulated hours. Compensation will be paid once per year, at the employee’s regular straight time rate of pay in respect to the hours accumulated as of March 1st in any year for which time-off has not been granted.
