Exceptions to the Agreement. 1. Nothing in this Agreement shall be construed to prevent any Party from taking any action or not disclosing any information which it considers necessary for the protection of its essential security interests relating to the procurement of arms, ammunition or war materials, or to procurement indispensable for national security or for national defence purposes. 2. Subject to the requirement that such measures are not applied in a manner which would constitute a means of arbitrary or unjustifiable discrimination between countries where the same conditions prevail or a disguised restriction on international trade, nothing in this Agreement shall be construed to prevent any Party from imposing or enforcing measures: necessary to protect public morals, order or safety, human, animal or plant life or health or intellectual property; or relating to the products or services of handicapped persons, of philanthropic institutions or of prison labour.

Exceptions to the Agreement. The Agency may approve exceptions to this Agreement if, in the opinion of the Agency, the benefits of the Group’s participation outweigh the Group’s inability to comply with a portion of this Agreement. To amend this Agreement, the Group shall submit a written request to the Agency for consideration for exception from a specific Agreement requirement. The request shall include the reasons for the Group’s inability to comply with this Agreement requirement. The request shall be submitted at the time this Agreement is submitted to the Agency for consideration. Execution of the Agreement by the Agency shall constitute acceptance of the request for an exception.
Exceptions to the Agreement. The parties agree that any member of the bargaining unit whose formal terms of appointment in respect of salary or entitlement to leave are contrary to the provisions of Articles 19, 20, or 25 shall be treated according to those terms of appointment, if the employee so desires.

Exceptions to the Agreement. 1. The competent authorities of the States Parties may establish exceptions (exemptions and exclusions) to this Agreement relating to: (a) The transport of machinery or apparatus containing dangerous substances and articles in their internal or operating equipment, provided that measures are taken to prevent the leakage of the contents; (b) Transport carried out by or under the supervision of the emergency services and necessary for rescue operations, in particular transport carried out in order to locate and collect dangerous goods in the event of an incident or accident and transport them to safety; (c) Urgent transport operations carried out by or under the supervision of the emergency services in order to rescue people or protect the environment, provided that measures are taken to ensure the safety of such operations; (d) The transport, marking and loading of individual explosives used for defence and military purposes belonging to the armed forces of the States Parties or for which the armed forces of the States Parties are responsible. 2. Technical requirements relating to exemptions or partial exemptions may be established by the competent authorities of the States Parties with regard to: (a) The transport of uncleaned empty static storage vessels (other than receptacles or storage vessels for transport) that have contained dangerous substances; (b) The transport of gases, fuel oil and lithium batteries; (c) Special provisions on the transport of individual materials or articles; (d) The transport of empty uncleaned packaging; (e) Maximum quantity of dangerous goods in a wagon or high-capacity container; (f) Dangerous substances that do not jeopardize the safety of transport operations on account of their quantity, type or packaging.
Exceptions to the Agreement. 1. This Agreement shall not preclude the application by either Contracting Party of the necessary procedures to maintain public order or to fulfill its obligations to maintain or restore peace and security, or to protect its fundamental security interests. 2. This Agreement shall not preclude any Contracting Party from taking any special procedures relating thereto to establish investments, provided that they do not prejudice any of the principles and rules provided for In this Agreement.
