(a) During any work by Pathnet or any of the Pathnet Parties pursuant to this Lease, Pathnet shall ensure that all tracks, supporting structures and roadbed of BNSF is supported in such manner as is necessary for the safe operation of BNSF without any slower speed or other train operating restrictions and, upon completion of such work, Pathnet shall ensure that all such tracks, supporting structures, and the roadbed are returned to their pre-existing condition, all at Pathnet's sole cost.
