Exceptions to Total Liability. The limits on liability set forth in Sections 4.4 and 14.7.1 shall not apply to any liability of Owner arising out of Owner’s gross negligence, willful misconduct (including willful breach of this Agreement), or fraud. The limits on liability set forth in Section 14.7.2 shall not apply to any liability of Distribution Company arising out of Distribution Company’s gross negligence, willful misconduct (including willful breach of this Agreement), or fraud.
