Exchange of Information. 1. The competent authorities of the Contracting States shall exchange such information as is foreseeably relevant for carrying out the provisions of this Agreement or to the administration or enforcement of the domestic laws concerning taxes of every kind and description imposed on behalf of the Contracting States, or of their political subdivisions or local authorities, insofar as the taxation thereunder is not contrary to the Agreement, in particular, to prevent fraud and to facilitate the administration of statutory provisions against legal avoidance. In the case of Switzerland, in order to obtain such information, its tax authorities, to comply with its obligations under this paragraph, shall have the power to enforce the disclosure of information covered by this paragraph, notwithstanding paragraph 3 or any contrary provisions in its domestic law. In the case of Singapore, in order to obtain such information, it shall ensure that when it is the requested Contracting State, its tax authorities shall have the power under its domestic laws to enforce the disclosure of information covered by this paragraph.

(1) Each of the Contracting States shall notify the other, through diplomatic channels, of the completion of the procedures required by its law for the bringing into force of this Protocol. The Protocol shall enter into force on the date of the later of these notifications.
(2) The provisions of this Protocol shall have effect with regard to tax years beginning on or after 1 January of the calendar year next following the year of the entry into force of this Protocol.

43. If Subject to the provisions of paragraph 2 of Article 31 (Termination), if information is requested by a Contracting State in accordance with this Article, the other Contracting State shall use its information gathering measures to obtain the requested information, even though information to which the request relates in the same manner and to the same extent as if the tax of the first-mentioned State were the tax of that other State may not need such information for its own tax purposesand were being imposed by that other State. The obligation contained in the preceding sentence is subject to the limitations of paragraph 3 application of this Article but in no case paragraph shall be suspended until such limitations be construed time as the Government of the United States receives from the Government of Thailand a diplomatic note indicating that Thailand is prepared and able to permit a Contracting State to decline to supply information solely because it has no domestic interest in such information.

4. For the purposes of this Article, the Convention shall apply, notwithstanding the provisions of Article 2 (Taxes Covered) to permit a Contracting State to decline to supply information solely because all taxes imposed:

3. In no case shall the provisions of paragraph paragraphs 1 and 2 be construed so as to impose im- pose on a Contracting State the obligation:
a) to carry out administrative measures at variance with the laws and administrative admin- istrative practice of that or of the other Contracting State;
b) to supply information which is not obtainable under the laws or in the normal course of the administration of that or of the other Contracting State;
c) to supply information which would disclose any trade, business, industrial, commercial or professional secret or trade process, or information the disclosure dis- closure of which would be contrary to public policypolicy (ordre public).

(c) to supply information which would disclose any trade, business, industrial, commercial or professional secret or trade process, or information information, the disclosure of which would be contrary to public policypolicy (ordre public).

If information is requested by a Contracting State in accordance with this Article, the other Contracting State shall use its information gathering measures to obtain the requested information, even though that other State may not need such information for its own tax purposes. c) to supply information which would disclose any trade, business, industrial, commercial commercial, or professional secret or trade process, or information the disclosure of which would be contrary to public policypolicy (ordre public).
43. If Subject to the provisions of paragraph 2 of Article 31 (Termination), if information is requested by a Contracting State in accordance with this Article, the other Contracting State shall use its information gathering measures to obtain the requested information, even though information to which the request relates in the same manner and to the same extent as if the tax of the first-mentioned State were the tax of that other State may not need such information for its own tax purposesand were being imposed by that other State. The obligation contained in the preceding sentence is subject to the limitations of paragraph 3 application of this Article but in no case paragraph shall be suspended until such limitations be construed time as the Government of the United States receives from the Government of Thailand a diplomatic note indicating that Thailand is prepared and able to permit a Contracting State to decline to supply information solely because it has no domestic interest in such information.
5. In no case shall implement the provisions of paragraph 3 be construed this paragraph.
4. For the purposes of this Article, the Convention shall apply, notwithstanding the provisions of Article 2 (Taxes Covered) to permit a Contracting State to decline to supply information solely because all taxes imposed.
(i) in the information is held by a bankcase of the United States, other financial institutionunder the Internal Revenue Code; and
(ii) in the case of Thailand, nominee or person acting in an agency or a fiduciary capacity or because it relates to ownership interests in a personunder the Revenue Code, and under the Petroleum Income Tax Act.
