Common use of Excluded Liability Clause in Contracts

Excluded Liability. Except in relation to liability under clauses 26.10, 26.15, 26.16(b), 26.17, 26.18(b) and 27.3, neither the Distributor nor the Retailer will be liable for: (a) any loss of profit, loss of revenue, loss of use, loss of opportunity, loss of contract, or loss of goodwill of any person; or (b) any indirect or consequential loss (including, but not limited to, incidental or special damages); or (c) any loss resulting from liability of a party to another person (except any liability for Direct Damage that arises under clause 26.2); or (d) any loss resulting from loss or corruption of, or damage to, any electronically- stored or electronically-transmitted data or software.

Except in relation to liability under clauses 26.1017.5, 26.15, 26.16(b17.12 and 17.15(b), 26.17, 26.18(b) and 27.317.16(b), neither the Distributor nor the Retailer will be liable for: (a) any loss of profit, loss of revenue, loss of use, loss of opportunity, loss of contract, or loss of goodwill of any person; or (b) any indirect or consequential loss (including, but not limited to, incidental or special damages); or (c) any loss resulting from liability of a party to another person (except any liability for Direct Damage that arises under clause 26.217.2); or (d) any loss resulting from loss or corruption of, or damage to, any electronically- electronically-stored or electronically-transmitted data or software.
