Exclusion of categories of loss. The following applies only to the extent permitted by Law. All liability of ours is excluded in respect of any indirect or consequential Loss suffered or incurred by you, in relation to any Job, the Platform or any GoFetch Services, any delay or failure in providing any of them, or otherwise under or in connection with this agreement, and in any event (including where amounting to a direct loss) for any lost profits or goodwill.

All liability of the Fetcher and Customer is excluded in respect of any indirect or consequential Loss suffered or incurred by the other, in relation to any Job (or proposed Job), including any delay or failure by either party in connection with same, or otherwise under or in connection with this agreement, and in any event (including where amounting to a direct loss) for any lost profits or goodwill.

Without limiting the above, and only to the extent permitted by law, all liability of ours is excluded in relation to any Services received by you being in any way unsafe, not suitable for the relevant purpose, or not complying with the Services Description in any way.
Exclusion of categories of loss. All liability of Kineo on any basis (including but not limited to negligence) is excluded in respect of any indirect or consequential liability or loss suffered or incurred by Customer, in relation to the Subject Matter or otherwise under or in connection with this Agreement, and in any event (including but not limited to where amounting to a direct loss) for any lost profits or goodwill or lost or corrupted data. This Clause applies in addition to Clause 5.2, but only to the extent permitted by law.

The contractor shall take all necessary and reasonable steps to ensure nondiscrimination in the administration of this contract.

  • Forecasting Requirements for Trunk Provisioning Within ninety (90) days of executing this Agreement, Reconex shall provide Verizon a two (2) year traffic forecast. This initial forecast will provide the amount of traffic to be delivered to and from Verizon over each of the Local Interconnection Trunk groups over the next eight (8) quarters. The forecast shall be updated and provided to Verizon on an as-needed basis but no less frequently than semiannually. All forecasts shall comply with the Verizon CLEC Interconnection Trunking Forecast Guide and shall include, at a minimum, Access Carrier Terminal Location (“ACTL”), traffic type (Local Traffic/Toll Traffic, Operator Services, 911, etc.), code (identifies trunk group), A location/Z location (CLLI codes for Reconex-IPs and Verizon-IPs), interface type (e.g., DS1), and trunks in service each year (cumulative).

  • Loop Provisioning Involving Integrated Digital Loop Carriers 2.6.1 Where InterGlobe has requested an Unbundled Loop and BellSouth uses IDLC systems to provide the local service to the End User and BellSouth has a suitable alternate facility available, BellSouth will make such alternative facilities available to InterGlobe. If a suitable alternative facility is not available, then to the extent it is technically feasible, BellSouth will implement one of the following alternative arrangements for InterGlobe (e.g. hairpinning):

  • Voice Grade Unbundled Copper Sub-Loop Unbundled Sub-Loop Distribution – Intrabuilding Network Cable (aka riser cable)

  • Loop Provisioning Involving IDLC 2.16.1 Where TWTC has requested an Unbundled Loop and AT&T uses IDLC systems to provide the local service to the customer and AT&T has a suitable alternate facility available, AT&T will make such alternative facilities available to TWTC. If a suitable alternative facility is not available, then to the extent it is technically feasible, AT&T will implement one of the following alternative arrangements for TWTC (e.g., hairpinning):
