Common use of Exclusion of Liability of Unitholders Clause in Contracts

Exclusion of Liability of Unitholders. No holder of units of the Funds and no annuitant or beneficiary under a registered retirement savings plan, registered retirement income fund, registered education savings plan, deferred profit sharing plan or tax free savings plan of which any holder of units of a Fund is a trustee or carrier shall be subject to any personal liability whatsoever, in tort, contract or otherwise, to any person in connection with Property or obligations or the affairs of a Fund and all such persons shall look solely to the Property for satisfaction of claims of any nature arising out of or in connection therewith and the Property only shall be subject to levy or execution.
