Exclusion of Student by Teacher. 29 An employee shall have the right to remove a student from class when the 30 employee deems such action necessary to maintain order or discipline, provided 31 that, except in emergency circumstances, the teacher shall have first attempted 32 one or more alternative forms of corrective action. In no event shall an excluded 33 student be returned during the balance of that class or activity period (a class 34 period is fifty-five (55) minutes in length), or up to the following two days, or 35 until the principal or his or her designee and the teacher have conferred, without 36 the consent of the teacher. Students may be excluded from their individual 37 classes or activities for periods of time in excess of these time periods if such 38 students have repeatedly disrupted the learning of other students, subject to due 39 process rights of all students. 40
