Exclusion of Warranties and Liability. You acknowledge that all Equipment rented will be at your sole discretion and election as to what you require. No warranties, guarantees or representations are made by Nikon, its agents or representatives of any form or nature in respect of the performance of the Equipment. Nikon shall not be responsible or liable to you or third parties for any damage, including loss of profits or other special or consequential damage arising out of the use, malfunction or inability to use any Equipment.
