Exclusive Warranty for Third Party Software. Consultant's warranties do not apply to Third Party Software or Third-Party Commercial-Off-The-Shelf Software. Third Party Software or Third-Party Commercial-Off-The-Shelf Software manufacturer and any third party warranties shall, to the extent permissible, be passed through to NYSDOT. However, Consultant shall provide a work-around solution to any Third-Party Software, to allow the system to function to the highest extent reasonably possible within a reasonable time frame.
