Common use of Execution by Owner Clause in Contracts

Execution by Owner. If Design Professional is the Owner’s Authorized Representative, then notwithstanding any provision in the Contract to the contrary, Design Professional has no authority to execute Change Orders or Amendments on behalf of Owner, and only duly authorized personnel of Owner may do so.

Execution by Owner. If Design Professional Consultant is not the Owner’s Authorized Representative, then notwithstanding any provision in the Contract to the contrary, Design Professional Architect has no authority to execute Change Orders or Amendments on behalf of Owner, and only duly authorized personnel of Owner may do so.
