Common use of Exhaustion of Title XXI Funds Clause in Contracts

Exhaustion of Title XXI Funds. After the State has exhausted title XXI funds, expenditures for optional targeted low-income children within the CHIP State Plan approved income levels, may be claimed as title XIX expenditures, as approved in the Medicaid State Plan. The State shall report expenditures for these children, identified as “Optional State Plan Children,” as waiver expenditures on the Forms CMS 64.9 Waiver and/or CMS 64.9P Waiver in accordance with the instructions that can be found in section XIII, paragraph 53 entitled Reporting Expenditures Under the Demonstration.
