Existing Documents. The Contractor has reviewed and taken into consideration the Bidding Documents in preparing his bid.

Existing Documents. Design-Builder recognizes the existence of existing contract documents, if any, prepared on behalf of the Owner and identified in Exhibit A. The Design-Builder has carefully reviewed these documents, if any, and has determined them to be, at the time of execution of this Contract, complete and sufficient for the construction of the portion of the project for which they were produced. The Design-Builder has made, or will make within 15 days, with the assistance of the Owner and Program Manager, any correction or adjustments necessary to their use prior to beginning any construction of the Work identified on such documents.

CM/GC affirms that it has reviewed the Using Agency’s Project Development Information, attached hereto as Exhibit A, and the Preliminary Design and Construction Schedule, attached hereto as Exhibit B; that it has taken them into consideration in preparing its proposal for the General Conditions and Fee; and that it knows of no reason why the Project could not be completed within the current GMP Cost Limitation by the Material Completion Date. The Contract. The Contract includes Exhibits A through C, the General Requirements, GSFIC Forms Packet, and Supplementary General Requirements, each of which are incorporated herein.
Existing Documents. Defined terms in documents accepted in connection with your acceptance of this Agreement that reference a Technology Services Agreement shall be deemed amended to reference analogous terms defined in this Agreement, including by replacing the term “Technology Services Agreement” with “Platform Access Agreement”.

1.3.1 the Principal Agreement to “this Agreement”; and
1.3.2 the Principal Corporate Guarantee to “this Guarantee”, shall, with effect from the Effective Date and unless the context otherwise requires, be references to the Principal Agreement and the Principal Corporate Guarantee, respectively, as amended by this Agreement and words such as “herein”, “hereof”, “hereunder”, “hereafter”, “hereby” and “hereto”, where they appear in the Principal Agreement and/or the Principal Corporate Guarantee shall be construed accordingly.
