Existing Services. Active existing services shall be adequately protected from damage. Where active services are encountered but not shown on the drawings, the Architect shall be notified by the contractor. Where inactive services are encountered upon the site of the works, they shall be removed or sealed off in accordance with the direction of the Architect.
Existing Services. In the disconnection and sealing of services the Contractor is to comply with the requirements of the Authorities concerned and is to allow in his prices for serving all notices and paying all fees as necessary. The Contractor must take all necessary precautions and will be responsible for damage caused to any underground cables or services which exist on site.
Existing Services. D.4.1. The Contractor is responsible for ensuring that the Works do not interfere or damage existing services to the Site.
Existing Services. Drains, pipes, cables and similar services encountered in the course of the Works shall be guarded from damage by the Contractor at his own cost to safeguard a continued uninterrupted use to the satisfaction of the owners thereof, and the Contractor shall not store materials or otherwise occupy any part of the site in the manner likely to hinder the operation of such services. The Contractor shall on the Engineer's direction arrange for the construction of permanent or temporary diversions of the said drains etc. together with their reinstatement in liaison with the respective Departments, Bodies, Corporations or Authorities. The cost of such works or diversions including reinstatement shall be charged against the appropriate provision sum provided into the Bills of Quantities. The Contractor shall be at liberty, subject to the approval of the works, bear the cost of reinstatement of addition diversion. No services may be tampered with by the Contractor and all works in connection with any kind of services shall be carried out by their respective owners. It is the responsibility of the contractor to inform the Engineer immediately any existing service is exposed.
Existing Services. None Services to be Provided: The Building Inspection Department will provide Code Compliance Services upon annexation. This includes issuing building, electrical, mechanical and plumbing permits for any new construction and remodeling and enforcing all other applicable codes which regulated building construction within the City of Willow Park.
Existing Services. None Services to be Provided: The Planning and Zoning Department’s responsibility for regulating development and land use through the administration of the City of Willow Park Zoning Ordinance will extend to this area on the effective date of the annexation. The property will also continue to be regulated under the requirements of the City of Willow Park Subdivision Ordinance. These services can be provided within the department’s current budget and staff appropriation.
Existing Services. The right to continue to use all Conduits existing at the date hereof serving the Railway Premises and the Adjoining Premises laid in, on, under or over the Premises for the free and uninterrupted passage of surface water and sewage from and running of water soil gas electricity telecommunications and other services from and to the Adjoining Premises together with the right to enter and inspect repair maintain renew replace clean sever connections to and remove the same Provided Always that the Tenant shall (at its own cost) be entitled at any time upon giving to the Landlord prior written notice to divert relocate or remove any such Conduits subject to:
1.1 any such diverted or relocated Conduits being no less convenient and commodious (the "Alternative Conduit Routes"); and
1.2 replacement rights being granted in respect of the Alternative Conduit Routes otherwise on the terms of the rights reserved in this Lease; and
1.3 there being no interruption (whether temporary or otherwise) to the provision of these services rights; and the Landlord on being requested in writing by the Tenant to do so will enter into a deed at the reasonable and proper cost of the Tenant to effect the surrender of the relevant right or rights and to grant the replacement rights in favour of the Landlord (and those authorised by it) over the Alternative Conduit Routes in a form approved by the Landlord (such approval not to be unreasonably withheld or delayed).
Existing Services. County Street Maintenance Services to be Provided: Maintenance to the streets will be provided by the City of Willow Park on the effective date of the annexation. This service can be provided within the current budget appropriation.
Existing Services. The tendered rate shall further cover the cost of backfilling the excavation with selected material compacted to 90% Mod. AASHTO density, keeping the excavation safe, and taking care that the services are not damaged in any way. The rate shall include for all negotiations with the authorities, notification to all affected parties and any other requirement to protect and complete the work.
Existing Services. During the Transition Period, PwCES shall provide the Services consistent with the manner in which the tasks, functions or projects addressed by the Services were delivered by Equifax prior to the Commencement Date or as mutually agreed upon and set forth in Exhibit 2. In those instances where there is neither sufficient nor historical data available to establish Service Levels, the parties shall mutually agree and establish such Service Levels during the Transition Period. After the Transition Period, PwCES shall provide the Services consistent with the Service Levels as mutually agreed upon and as set forth in Exhibit 2, which in no event shall be less than the manner in which the services were provided by Equifax prior to the Commencement Date.
