Extension of Commercial Operation Milestone Date. No later than thirty (30) days prior to the then-applicable Commercial Operation Milestone Date, Seller may elect to extend the Commercial Operation Milestone Date by six (6) months by providing, or causing to be provided, to NYSERDA, in addition to the cumulative amounts provided under Section 15.01(a) and (b), Contract Security, in the form of cash, certified funds, a Letter of Credit conforming to the requirements of Section 15.04, or an Acceptable Guaranty conforming to the requirements of Section 15.06, in an amount equal to the product of (i) the Bid Quantity and (ii) two dollars ($2.00). Extensions of the Commercial Operation Milestone Date as extended in accordance with the foregoing sentence of this Section 15.02 shall not exceed thirty- six (36) months beyond the Initial Commercial Operation Milestone Date.
Extension of Commercial Operation Milestone Date. Seller may elect to extend the Commercial Operation Milestone Date as follows: 9 For Sellers that have executed a Mutual Termination Agreement, the Termination Agreement Contract Security shall be in addition to, and not in substitution of, any other Contract Security to be delivered under this Agreement.

  • TIME OF COMMENCEMENT AND SUBSTANTIAL COMPLETION (i) The work under this Contract shall commence within seven (7) calendar days of receipt of Notice to Proceed and will be substantially complete within thirty (80) calendar days after the date when the Contract Time commences to run as provided in paragraph 2.03 of the General Conditions and completed and ready for final payment within ninety (90) calendar days after the date when the Contract Time commences to run.

  • Commercial Operation (i) On or before December 31, 2021, Interconnection Customer must demonstrate commercial operation of all generating units. Demonstrating commercial operation includes achieving Initial Operation in accordance with Section 1.4 of Appendix 2 to this ISA and making commercial sales or use of energy, as well as, if applicable, obtaining capacity qualification in accordance with the requirements of the Reliability Assurance Agreement Among Load Serving Entities in the PJM Region.

  • Project/Milestones Taxpayer is a manufacturer and distributor of eyeglass lenses. In consideration for the Credit, Taxpayer agrees to hire full-time employees and invest in manufacturing equipment, computer equipment, furniture and fixtures, and tenant improvements as part of its expansion in Torrance and Los Angeles County, California (collectively, the “Project”). Further, Taxpayer agrees to satisfy the milestones as described in Exhibit A (“Milestones”) and must maintain Milestones for a minimum of three (3) taxable years thereafter. In the event Taxpayer employs more than the number of full-time employees, determined on an annual full-time equivalent basis, than required in Exhibit A, for purposes of satisfying the “Minimum Annual Wage of California Full-time Employees Hired” and the “Cumulative Average Annual Wage of California Full-time Employees Hired,” Taxpayer may use the wages of any of the full-time employees hired within the required time period. For purposes of calculating the “Minimum Annual Wage of California Full-time Employees Hired” and the “Cumulative Average Annual Wage of California Full-time Employees Hired,” the wage of any full-time employee that is not employed by Taxpayer for the entire taxable year shall be annualized. In addition, the wage of any full-time employee hired to fill a vacated position in which a full-time employee was employed during Taxpayer’s Base Year shall be disregarded.

  • Failure to Achieve Commercial Operation If the Large Generating Facility fails to achieve Commercial Operation, but it or another generating facility is later constructed and makes use of the Network Upgrades, the Participating TO shall at that time reimburse Interconnection Customer for the amounts advanced for the Network Upgrades. Before any such reimbursement can occur, the Interconnection Customer, or the entity that ultimately constructs the generating facility, if different, is responsible for identifying and demonstrating to the Participating TO the appropriate entity to which reimbursement must be made in order to implement the intent of this reimbursement obligation.
