Common use of Facilities Constructed on City Land Clause in Contracts

Facilities Constructed on City Land. If the Facilities to be acquired are on land owned by the City, including land as to which the City has acquired sufficient property rights in the manner described in Section 4.3 or otherwise, the City hereby grants to the Owner a license to enter upon such land for purposes related to the construction (and maintenance pending acquisition) of the Facilities. The provisions for inspection and acceptance of such Facilities otherwise provided herein shall apply.

Facilities Constructed on City Land. If the Facilities to be acquired are on land owned by by, or the subject of an easement granted to, the City, including land as to which upon request of the Developer the City has acquired sufficient property rights in the manner described in Section 4.3 or otherwise, the City hereby grants will issue to the Owner Developer a license permit to enter upon such land for purposes related to the construction (and maintenance pending acquisition) of the Facilities. The provisions for inspection and acceptance of such Facilities otherwise provided herein shall apply.
