Common use of Facility Agent’s Responsibility Clause in Contracts

Facility Agent’s Responsibility. (a) The Facility Agent’s responsibility for examination of the documents presented pursuant to this Clause 4 (Conditions Precedent) shall be limited to establishing that they appear on their face to comply with the documents specified above within the meaning of article 14a of the Uniform Customs and Practice for Documentary Credits (2007 Revision) of the International Chamber of Commerce (Publication nr. 600). For the avoidance of doubt, documents which appear on their face to be inconsistent with one another shall not be considered to be in order.

For the avoidance of doubt, documents documents, which appear on their face to be inconsistent with one another shall not be considered to be in order.
