Common use of Failure of Allottee to Clause in Contracts

Failure of Allottee to. take possession of Apartment/ Unit - Upon receiving a written intimation from the Vendor/Developer as per Para 7.2 above, the Allottee(s) shall take possession of the [Flat/Unit] from the Vendor/Developer by executing necessary indemnities, undertakings and such other documentation as prescribed in this Agreement and the Vendor/Developer shall give possession of the [Flat/Unit] to the Allottee(s). In case the Allottee(s) fails to take possession within the time provided as per Para 7.2 above, such Allottee shall continue to be liable to pay maintenance charges as specified under Para 7.2 above.

Failure of Allottee to. take possession of Apartment/ Unit - Apartment- Upon receiving a written intimation from the VendorOwner/Developer Vendor as per Para 7.2 above, the Allottee(s) Allottee(s)/ Purchaser shall take possession of the [Flat/Unit] Apartment from the VendorOwner/Developer Vendor by executing necessary indemnities, undertakings and such other documentation as prescribed in this Agreement and the VendorOwner/Developer Vendor shall give possession of the [Flat/UnitApartment] to the Allottee(s)Allottee(s)/Purchaser. In case the Allottee(s) Allottee(s)/Purchaser fails to take possession within the time provided as per Para 7.2 above, such Allottee shall continue to be liable to pay maintenance charges as specified under Para 7.2 above.

In case the Allottee(s) fails to take possession within the time provided as per Para 7.2 above, such Allottee shall continue to be liable to pay maintenance charges as specified under Para 7.2 above.
