Failure of the State to Enforce the Independent Evaluator Agreement. After receiving fifteen (15) days’ written notice from the Lead Provider, after expiration of all applicable notice and cure periods, the State fails to enforce the terms of the Independent Evaluator Agreement such that (i) an on-going event of default is continuing under such agreement, and (ii) the State is not diligently exercising its contractual remedies to cure such default.
