Common use of Failure to Abide by DBE Requirements Clause in Contracts

Failure to Abide by DBE Requirements. Failure by Supplier to carry out the requirements of PSTA’s DBE Program and the requirements of 49 CFR Part 26, and/or timely return of retainage, without just cause, is a material breach of this Agreement, which may result in PSTA withholding payment from Supplier until all delinquent payments have been made (no interest will be paid for the period that payment was withheld), termination of this Agreement, or other such remedy as PSTA deems appropriate.
