Common use of Failure to Achieve AVR Not a Default Clause in Contracts

Failure to Achieve AVR Not a Default. Failure to achieve the AVR performance standard as provided in this Agreement will not constitute a Default within the meaning of the Agreement so long as Developer is working cooperatively with the City and taking all feasible steps to achieve compliance as required by this Agreement. The term “feasible” shall mean capable of being accomplished in a successful manner within a reasonable period of time, taking into account economic, environmental, and technological factors.
