Common use of Failure to Comply With Other Agreements Clause in Contracts

Failure to Comply With Other Agreements. If the Recipient: (a) has failed to comply with any term, condition or obligation under any other agreement with the City (“Failure”); (b) has, if applicable, failed to rectify such Failure in accordance with the requirements of such other agreement; and (c) such Failure is continuing, Then such Failure is deemed an Event of Default under this Agreement and the City may, at any time, take one or more of the actions or seek any remedy available to the City under this Agreement.
