Failure to Comply with Restricted Periods. (a) Seller shall operate the Project in a manner that does not cause an increase in net loading on the circuits specified in Appendix III during Restricted Periods. Whether an increase in net loading on the circuits specified in Appendix III has occurred during a particular Restricted Period will be determined by Buyer in accordance with the measurement and verification parameters set forth in Appendix XII.
