Common use of FAILURE TO CORRECT MATERIAL Clause in Contracts

FAILURE TO CORRECT MATERIAL. If Contractor fails to initiate correction of Materials or Work having Defects or Deficiencies in accordance with Section 17.4 within five (5) Days of Notice from Owner, Owner may correct such Materials or Work without relieving Contractor of any of its warranty obligations hereunder, and Owner’s costs associated with such activities shall be included in the calculation of Total Costs.
