Failure to exercise etc. not a waiver 16.3.1 No failure to exercise, nor delay or omission by any Party in exercising, any right, power or remedy conferred on it under this Agreement or provided by law shall except with the express written consent of that Party: (a) affect that right, power or remedy; or (b) operate as a waiver of it. 16.3.2 No single or partial exercise by any Party of any right, power or remedy shall prevent any further exercise of that right, power or remedy or the exercise of any other right, power or remedy.
