Common use of Failure to Maintain Premises Clause in Contracts

Failure to Maintain Premises. If Tenant fails to perform any obligation under Article 7.01, then on not less than ten days notice to Tenant Landlord may enter the Premises and perform such obligations without liability to Tenant for any loss or damage to Tenant thereby incurred, and Tenant shall pay Landlord the cost thereof, plus 20% of such cost for overhead and supervision, within ten days of receipt of Landlord's invoice therefor.

If Tenant fails to perform or commence and diligently perform any obligation under Article 7.01, then on not less than ten days days’ notice to Tenant Landlord may enter the Premises and perform such obligations obligation without liability to Tenant for any loss or damage to Tenant thereby incurred, and Tenant shall pay Landlord for the cost thereof, plus 2010% of such cost for overhead and supervision, within ten days of receipt of Landlord's ’s invoice therefor.

If Tenant fails to perform any obligation under this Article 7.017.00, then on not less than ten days days' notice to Tenant (except in the case of emergency), Landlord may enter the Premises and perform such obligations obligation without liability to Tenant for any loss or damage to Tenant thereby incurred, and Tenant shall pay Landlord for the cost thereof, plus 20% of such cost for overhead and supervision, thereof within ten (10) days of receipt of Landlord's invoice demand therefor.
