Common use of Failure to Pay Rent Clause in Contracts

Failure to Pay Rent. Tenant fails to pay Base Rent or any Additional Rent as and when due and such failure continues for five (5) Business Days after Landlord delivers written notice thereof to Tenant except that Tenant shall not be entitled to notice more than twice in any consecutive twelve (12) month period and the failure to timely pay Base Rent or any other Additional Rent when due on the third and any subsequent instance of late payment in a consecutive twelve (12) month period shall be an immediate default.

Failure to Pay Rent. Tenant fails to pay Base Basic Rent, any monthly installment of Additional Rent for Property Expenses or any other Additional Rent amount as and when due and such failure continues for is not cured within five (5) Business Days after Landlord delivers written notice thereof to Tenant except that Tenant shall not be entitled Tenant, pursuant to notice more than twice in any consecutive twelve (12) month period and the Section 18.1, of Tenant's failure to timely pay Base Rent or any other Additional Rent when due on the third and any subsequent instance of late payment in a consecutive twelve (12) month period shall be an immediate defaultdue.

Tenant fails to pay Base Rent Basic Rent, any monthly installment of Tenant’s Share of Expenses or any other Additional Rent amount as and when due and such failure continues for five (5) Business Days after Landlord delivers gives Tenant written notice thereof to Tenant except that Tenant shall not be entitled to notice more than twice in any consecutive twelve (12) month period and the of Tenant’s failure to timely pay Base Rent or any other Additional Rent when due on the third and any subsequent instance of late payment in a consecutive twelve (12) month period shall be an immediate defaultdue.

Failure to Pay Rent. Tenant fails shall fail to pay Base any installment of the Rent herein reserved when due, or any Additional Rent as and other payment or reimbursement to Landlord required herein when due due, and such failure continues shall continue for a period of five (5) Business Days days after Landlord delivers gives Tenant written notice thereof to Tenant except that of such past due Rent or other payment; or Tenant shall not be entitled fail to notice more than twice in pay Rent or any consecutive other payment required herein within five (5) days after the date due, at any time during a twelve (12) month period and the in which Tenant has already received two (2) previous notices of its failure to timely pay Base Rent or any other Additional Rent when payments by the due on the third and any subsequent instance of late payment in a consecutive twelve (12) month period shall be an immediate defaultdate.
