FAILURE TO USE ARBITRATION PROCESS. Should either party pursue any dispute subject to this Exhibit A by any method other than set forth herein, the responding party shall be entitled to recover from the initiating party all damages, costs, expenses and attorneys' fees incurred as a result of appearing in, dismissing, staying or litigating such action.
