FAIR DISMISSAL AND TERMINATION OF EMPLOYEE. A. The Board agrees that termination of employment of faculty members shall be for just cause. Reduction of staff and layoff is described in Article 23 of this Agreement and is not defined as dismissal or termination. Xxxxxxxxxx of a tenure track faculty member is described in Article 16 of this Agreement and is not defined as dismissal or termination. B. Just cause shall be understood to include but not limited to 1. Physical or mental incapacity 2. Unprofessional conduct as evidenced by a. an act or conduct that threatens or injures personnel or property b. flagrant disregard of the terms of this Agreement
