Common use of Fall Protection Clause in Contracts

Fall Protection. 18.12.1 Contractor shall be required to provide 100% fall protection for all work 6 feet and above walking/working surfaces where guardrail protection is not in place (see Scaffold, Ladder, and Stairway sections). A. Steel Erectors/Pre-cast Erectors – 100% Fall Protection is required at 6 feet and above walking/working surfaces. B. Scaffold Systems – 100% Fall Protection is required at 6 feet and above walking/working surfaces. C. All other work - 100% Fall Protection is required at 6 feet and above walking/working surfaces 100% fall protection 18.12.2 Fall protection equipment shall be utilized in accordance with the manufacture’s requirements and/or per a registered professional engineering’s stamped fall protection plan. 18.12.3 A safe means of access shall be maintained to structural activities. 18.12.4 A guardrail system consisting of a top rail (39”– 45”) and mid-rail will be constructed at all unprotected sides, edges and floor openings where a recognized fall hazard to a lower level exists. The guardrail system will be capable of supporting 200 lbs and have a toe board installed for the protection of those working below. 18.12.5 Wire rope guardrail and perimeter slab edge systems will consist of a top rail, mid-rail and be flagged at not more than 6-foot intervals with high-visibility material. A minimum of three (3) U-bolt wire rope clips will be used and installed such that the “U” section is in contact with the dead end of the rope. Wire rope guardrail systems will be maintained to ensure the lowest point above the walking/working surface is no less than 39-inches and highest point no greater than 45-inches. 18.12.6 Openings in floors and roofs shall be provided with a guardrail fall protection system that includes 4" toe-boards unless a HOLE COVER is used. 18.12.7 Only roofers may use the Warning Line System set back a minimum of 6 feet from an unprotected edge on a low-sloped roof (a roof less than or equal to 4V in 12H). No roofer will be allowed in the area between the roof edge and the warning line without personal fall arrest system.

Anyone found violating this policy may be removed from the site immediately. Webcor/Obayashi does not allow the use of a Safety Monitor System. Each subcontractor is responsible for providing perimeter tie-off protection for its employees. The building perimeter cable is placed as a guardrail protection, and is not provided for tie-off protection. Ground Fault Circuit Interrupter (GFCI) protection is required for all electrical cords and tools. Each subcontractor shall provide GFCI-protected power strips for use in the building when permanent power has been energized and permanent outlets are placed in service. Each contractor will be responsible for providing and maintaining temporary GFCI’s for his or her employees if a GFCI receptacle is not available. Subcontractors shall submit their written LOTO program and documented employee training prior to beginning work on site. The program must include scope of training, pre-planning and specific LOTO procedures. All individuals who are working in or around the hazardous energy shall place their own lock and tag on the disconnect of the energy source. At no time will someone be allowed to remove another employee’s lock unless it has been cleared through Webcor/Obayashi competent supervision. Subcontractor competent person is responsible for identifying any floor opening/hole requiring to be protected. All floor openings/holes shall be covered/protected using appropriate materials. The covers must be able to withstand 2x the load and be secured to the floor and will be inspected daily by the subcontractor competent person. All floor/hole covers shall be clearly marked “Hole Do Not Remove” in a high visible color. All hole covers must be in compliance with OSHA’s 29 CFR 1910.23 (a) – 1910.23

Fall Protection. 18.12.1 Contractor Contractors are responsible to comply at a minimum with the following regulations pertaining to fall protection in the workplace as it applies to their work at WPCB facilities: • 29 CFR 1926 Subpart M – Fall Protection • 29 CFR 1910.23 – Guarding Floors, Wall Openings and Holes • Reasonable fall protection shall be provided to protect employees from accidental falls associated with floors, platforms, scaffolds, guardrails, physical barriers, elevated work locations, trenches and excavations. • Fall protection devices must be rate for industrial use and must be used according to the manufacturer recommendations. • Standard guardrails must be provided for work locations 6 feet or more above the adjacent level per 29 CFR 1926.500 and personal fall protection as required. • All employees working at unguarded locations above 6 feet in construction (10 feet on scaffolds) must be protected by properly wearing approved fall protection equipment including safety harnesses and life lines as specified in 29 CFR 1926.500. • Protection for floor openings, wall openings and hols are to include railing and toe boards as outlined in 29 CFR 1910.23. • All employees required to provide 100% wear approved fall protection devices must be properly trained concerning the need for all work 6 feet and above walking/working surfaces where guardrail protection is not purpose of the protection. They must also be instructed in place (see Scaffoldthe proper use, Laddercare, and Stairway sections). A. Materials such as wood, pipe, angle iron and concrete jersey barriers should be used. Snow fencing or the equivalent and tape are not acceptable. ‘Caution’ and ‘Danger’ tape are only used to commuinicate hazards and are not sunstantial enough to act as a barrier or prevent access. • Contractor’s must provide all employees with a guardrail exposure to fall hazards personal fall protection system equipment or other hazard control measures listed within the fall protection standard and ensure their proper use. • Contractors must ensure that includes 4" toe-boards unless a HOLE COVER is usedfall related hazards are thoroughly communicated to Contractor employees,sub Contractors and anyone who might be exposed. The communication must be adequate for the hazard. 18.12.7 Only roofers may use the Warning Line System set back a minimum of 6 feet from an unprotected edge on a low-sloped roof (a roof less than or equal to 4V in 12H). No roofer will be allowed in the area between the roof edge and the warning line without personal fall arrest system.
