Product Testing. No later than [**] prior to a scheduled Delivery ARIAD US shall send to ARIAD SWISSCO the Delivery Documents for review. Following such review, unless within [**] of receipt of the Delivery Documents ARIAD SWISSCO gives written notice of rejection of the Product to be delivered, stating the reasons for such rejection, the Delivery [**] = Portions of this exhibit have been omitted pursuant to a confidential treatment request. An unredacted version of this exhibit has been filed separately with the Commission. shall proceed, and both Parties shall organize the same. Upon arrival at ARIAD SWISSCO nominated site it shall visually inspect the shipment of the Product to identify any damage to the external packaging. ARIAD SWISSCO may reject any shipment (or portion thereof) of the Product that is damaged by providing to ARIAD US reasonable evidence of damage within [**] after Delivery of such Product. If ARIAD SWISSCO does not so reject any shipment (or portion thereof) of the Product within [**] of Delivery of such Product, ARIAD SWISSCO shall be deemed to have accepted such shipment of the Product; provided, however, that in the case of the Product having any Latent Defect, ARIAD SWISSCO shall notify ARIAD US promptly once it becomes aware that a Product contains a Latent Defect and subsequently may reject such Product by giving written notice to ARIAD US of ARIAD SWISSCO’s rejection of such Product and shipping a representative sample of such Product or other evidence of Non-Conformance to ARIAD US within [**] after becoming aware of such Latent Defect, which notice shall include a description of the Latent Defect.
Product Testing. Upon request, Customer shall provide Operator a laboratory report for each Product delivery by Customer or Customer’s supplier. Operator will not be obligated to receive Contaminated Product for throughput across the Berths, nor will Operator be obligated to accept Product that fails to meet the quality specifications set forth in the arrival notice.
Product Testing. If HR knows or reasonably suspects that any Distiller’s Grains produced at the Plant do not meet the warranty in Section 7.A or Section 7.B, HR shall promptly so notify UBE so that such Distiller’s Grains can be tested before loading the Distiller’s Grains at the Plant. If UBE knows or reasonably suspects that any Distiller’s Grains produced at the Plant do not meet the warranty in Section 7.A or Section 7.B, then UBE may obtain independent laboratory tests of the affected Distiller’s Grains. If such Distiller’s Grains are tested and found to comply with the warranty in Section 7.A and Section 7.B, then UBE shall pay all testing costs, and if the Distiller’s Grains are found not to comply with the warranty in Section 7.A and Section 7.B, HR shall pay all testing costs.
Product Testing. Product samples will be sealed and transmitted to the Independent Lab or Purchaser to perform the ultimate and proximate analyses. These tests are the same as for the lignite testing with the added testing for product density and Iodine number. Product Testing. Upon notification by ADOT to of the completion of the initial assembly and testing of the Product by or under the direction of ADOT, any Acceptance Test shall be performed at a mutually designated location in the presence of representatives of Wang. If the Acceptance Test is successfully completed, will complete the agreed upon payment schedule. If the Acceptance Test is not successfully completed, ADOT shall use its best efforts to make the necessary corrections to the Product within thirty days of receipt of notice of nonacceptance, at which time the Acceptance Test shall again be conducted.
