Common use of FEATURES OF SOFTWARE Clause in Contracts

FEATURES OF SOFTWARE. a. During the License Period of the Software, You have the right to use features of software. b. During the License Period of the Software, You have the right to receive free Updates of the Software as and when Quick Heal publishes the Updated Virus-database and free version upgrade as and when Quick Heal releases new version upgrade. You agree, understand and accept that You will be required to regularly download Updates published by Quick Heal. Any and all Updates/upgrades you receive from Quick Heal shall be governed by this Agreement, or as amended from time to time by Quick Heal. c. You agree, accept and acknowledge: i. that You are solely responsible for the configuration of the Software Settings and the results, actions, inactions initiated due to the same and Quick Heal assumes no liability/responsibility in any case and the Clause of Indemnification shall be applicable. ii. that Quick Heal assumes no liability/responsibility for any data deletion, including but not limited to any deletion/loss of personal, and/or confidential data; and/or uninstallation of third party apps; and/or change in settings; and / or change in contacts and / or Deletion/loss of contacts, specifically authorized by You or occurs due to the actions, inactions (whether intentional or not) by You or any third party whom You have authorized to use, handle your Device due to features of Software. iii. that to avail/use certain features of the Software, you may be required to incur some cost and that Quick Heal does not warrant that the usage of certain features of the Software are free of cost and that Quick Heal shall not entertain and expressly disclaims, any claim for reimbursement of any expenses including but not limited to any direct or incidental expenses arising out of Your usage of such features of the Software. iv. that you be solely responsible and shall comply all applicable laws, regulations of India and any foreign laws including without limitation, privacy, obscenity, confidentiality, copyright laws for using any report, data, information derived as a result of using the Software. v. that while using the Software, Quick Heal suggests some actions to be initiated by You in your sole benefit, for example “Quick Heal software may suggest You to uninstall infected applications”, however such actions are suggestive and Quick Heal takes no responsibility/liability if you perform such suggestive actions or not and Quick Heal assumes no responsibility/liability for any liability arising out of such actions/inactions.

That the software does not warrant that the data usage report provided by the Data Usage feature of the software will accurately match with the data usage report of your telecom service provider. Hence Quick Heal assumes no responsibility/liability in case of any discrepancies/ deviations in the data usage report provided by the software and your Telecom service provider. d. That Quick Heal shall not be responsible or liable for data deletion authorized by You whether intentionally or unintentionally. The mentioned data may include any personal or confidential information. e. You agree, understand and accept that You will be required require to regularly download Updates published by Quick Heal. That the software does not warrant that the data usage summary of the data used by apps as provided by the Data Usage feature of the software will accurately match with the data usage report of your telecom service provider. Hence Quick Heal assumes no responsibility/liability in case of any discrepancies/ deviations in the data usage report provided by the software and your Telecom service provider. C. That Quick Heal shall not be responsible or liable for data deletion authorized by You whether intentionally or unintentionally. The mentioned data may include any personal or confidential information. D. You agree, accept and acknowledge: i. that You are solely responsible for the configuration of the Software Settings and the results, actions, inactions initiated due to the same and Quick Heal assumes no liability/responsibility in any case and the Clause of Indemnification shall be applicable. ii. that Quick Heal assumes no liability/responsibility for any data deletion, including but not limited to any deletion/loss of personal, and/or confidential data; and/or uninstallation of third party apps; and/or and / or change in settings; and / or change in contacts and / or Deletion/loss of contacts, and / or SMS logs & call logs, and / or Images & Videos; specifically authorized by You or occurs due to the actions, inactions (whether intentional or not) by You or any third party whom You have authorized to use, handle your Device Mobile due to features of Software. iii. that to avail/use certain features or additional applications of the Software, you may be required require to incur some cost and that Quick Heal does not warrant that the usage of certain features or additional applications of the Software are free of cost and that Quick Heal shall not entertain and expressly disclaims, any claim for reimbursement of any expenses including but not limited to any direct or incidental expenses arising out of Your usage of such features of the Software. iv. You accept and agree that you allow Quick Heal (if so requires by Quick Heal) to take back-up of your device on our server as backup of your device. Quick Heal is not responsible for any IPR issues on backup of your data and You are responsible for any IPR issues alone. v. that you be solely responsible and shall comply all applicable laws, regulations of India and any foreign laws including without limitation, privacy, obscenity, confidentiality, copyright laws for using any report, data, information derived as a result of using the SoftwareSoftware and Quick Heal RDM service. v. vi. that while using the Software, Quick Heal suggests some actions to be initiated by You in your sole benefit, for example “Quick Heal software may suggest You to uninstall infected applications”, however such actions are suggestive and Quick Heal takes no responsibility/liability if you perform such suggestive actions or not and Quick Heal assumes no responsibility/liability for any liability arising out of such actions/inactions. vii. that the Software is equipped with mechanism to block malicious websites. The Software may block access to any web page which is found to be infected with malicious contents. Quick Heal shall not be responsible for any loss or damage including but not limited to financial, notional, loss of business if you are abstained from accessing any particular webpage or URL.

You accept and agree that you allow Quick Heal to take backup of your device on our server as backup of your device. Quick Heal is not responsible for any IPR issues on backup of your data and You are responsible for any IPR issues alone. v. that you be solely responsible and shall comply all applicable laws, regulations of India and any foreign laws including without limitation, privacy, obscenity, confidentiality, copyright laws for using any report, data, information derived as a result of using the SoftwareSoftware and Quick Heal RDM service. v. vi. that while using the Software, Quick Heal suggests some actions to be initiated by You in your sole benefit, for example “Quick Heal software may suggest You to uninstall infected applications”, however such actions are suggestive and Quick Heal takes no responsibility/liability if you perform such suggestive actions or not and Quick Heal assumes no responsibility/liability for any liability arising out of such actions/inactions. vii. that before expiry of the license period You shall take the back up of the data stored in your mobile. You understand and accept that You will not be able to restore the data after 15 days from the expiry of License period unless You renew your Quick Heal license within 15 days from the expiry of License period. Quick Heal reserves the right to delete/purge backup from our server after 15 days from the expiry of the license period. viii. that the Software is equipped with mechanism to block malicious websites. The Software may block access to any web page which is found to be infected with malicious contents. Quick Heal shall not be responsible for any loss or damage including but not limited to financial, notional, loss of business if you are abstained from accessing any particular webpage or URL.

(ii. ) that Quick Heal assumes no liability/responsibility for any data deletion, including but not limited to any deletion/loss of personal, and/or confidential data; and/or uninstallation of third party apps; and/or change in settings; and / or change in contacts and / or Deletion/loss of contacts, and / or SMS logs & call logs,; specifically authorized by You or occurs due to the actions, inactions (whether intentional or not) by You or any third party whom You have authorized to use, handle your Device Mobile due to features of Software. (iii. ) that to avail/use certain features of the Software, you may be required to incur some cost and that Quick Heal does not warrant that the usage of certain features of the Software are free of cost and that Quick Heal shall not entertain and expressly disclaims, any claim for reimbursement of any expenses including but not limited to any direct or incidental expenses arising out of Your usage of such features of the Software. (iv) You accept and agree that you allow Quick Heal to take backup of your device on our server. You have given unconditional acceptance to use your backup by Quick Heal for business purpose. (v) that you be solely responsible and shall comply all applicable laws, regulations of India and any foreign laws including without limitation, privacy, obscenity, confidentiality, copyright laws for using any report, data, information derived as a result of using the SoftwareSoftware and Quick Heal RDM services. v. (vi) that while using the Software, Quick Heal suggests some actions to be initiated by You in your sole benefit, for example “Quick Heal software may suggest You to uninstall infected applications”, however such actions are suggestive and Quick Heal takes no responsibility/liability if you perform such suggestive actions or not and Quick Heal assumes no responsibility/liability for any liability arising out of such actions/inactions.

The mentioned data may include any personal or confidential information. e) You agree, accept and acknowledge: i. (i) that You are solely responsible for the configuration of the Software Settings and the results, actions, inactions initiated due to the same and Quick Heal assumes no liability/responsibility in any case and the Clause No. 10 of Indemnification shall be applicable. (ii. ) that Quick Heal assumes no liability/responsibility for any data deletion, including but not limited to any deletion/loss of personal, and/or confidential data; and/or uninstallation of third party apps; and/or and / or change in settings; and / or change in contacts and / or Deletion/loss of contacts, and / or SMS logs & call logs,; specifically authorized by You or occurs due to the actions, inactions (whether intentional or not) by You or any third party whom You have authorized to use, handle your Device Mobile due to features of Software. (iii. ) that to avail/use certain features of the Software, you may be required require to incur some cost and that Quick Heal does not warrant that the usage of certain features of the Software are free of cost and that Quick Heal shall not entertain and expressly disclaims, any claim for reimbursement of any expenses including but not limited to any direct or incidental expenses arising out of Your usage of such features of the SoftwareXxxxxxxx.Xxx accept and agree that you allow Quick Heal to take backup of your device on our server. You have given unconditional acceptance to use your backup by Quick Heal for business purpose. (iv. ) that you be solely responsible and shall comply all applicable laws, regulations of India and any foreign laws including without limitation, privacy, obscenity, confidentiality, copyright laws for using any report, data, information derived as a result of using the Software.Software and Quick Heal RDM service v. (v) that while using the Software, Quick Heal suggests some actions to be initiated by You in your sole benefit, for example “Quick Heal software may suggest You to uninstall infected applications”, however such actions are suggestive and Quick Heal takes no responsibility/liability if you perform such suggestive actions or not and Quick Heal assumes no responsibility/liability for any liability arising out of such actions/inactions. (vi) that before expiry of the license period You shall take the back up of the data stored in your mobile. During the License Period subscription period of the Softwaresoftware, You have the right to receive free Updates updates of the Software software and service via Internet as and when Quick Heal the Company publishes the Updated Virus-database and free version upgrade as update and when Quick Heal the Company releases new version upgrade. You agree, understand and accept that You will be required to regularly download Updates updates published by Quick Healthe Company. Any and all Updatesupdates/upgrades you receive from Quick Heal the Company shall be governed by this Agreement, or as amended from time to time by Quick Healtime. c. C. You agree, accept and acknowledge: i. I. that You are solely responsible for the configuration of the Software Settings software settings and the results, actions, inactions initiated due to the same and Quick Heal the Company assumes no liability/responsibility in any case and the Clause No. 10 of Indemnification shall be applicable. iiII. that Quick Heal You have full authority to upload data of any third-party on the Software and the Company shall not be responsible in any manner whatsoever for third-party datas uploaded by you on the Software or any claims made by such third-parties. III. that You shall be solely responsible for the third-party datas uploaded by you on the Software, the Company assumes no responsibility / liability for the same. IV. that Company assumes no liability/responsibility for any data deletion, including but not limited to any deletion/loss of personal, and/or confidential data; and/or uninstallation of third third-party apps; and/or change in settings; and / or change in contacts and / or Deletion/loss of contacts, ; specifically authorized by You or occurs due to the actions, inactions (whether intentional or not) by You or any third party whom You have authorized to use, handle your Device due to features of Softwaresoftware. iii. V. that to avail/use certain features of the Softwaresoftware, you may be required to incur some cost and that Quick Heal Company does not warrant that the usage of certain features of the Software software are free of cost and that Quick Heal the Company shall not entertain and expressly disclaims, any claim for reimbursement of any expenses including but not limited to any direct or incidental expenses arising out of Your usage of such features of the Softwaresoftware. ivVI. You accept and agree that you allow Company to take backup of your data on our server including third-party data. VII. that you be solely responsible and shall comply all applicable laws, regulations of India and any foreign laws including without limitation, privacy, obscenity, confidentiality, copyright laws for using any report, data, information derived as a result of using the Softwaresoftware and Software service. v. that while using D. Certain functions of our device may not be available/ perform during updates. Your consent, may be required for the update, only after the receipt of your consent the software shall be updated. In case, you do not provide your consent for the update, the software shall not be updated to the upgraded version. c. iii. You agree, accept and acknowledge: i. a. that You you are solely responsible for the configuration of the Software Settings software settings and the results, actions, inactions initiated due to the same and same. Quick Heal assumes no shall not hold any liability/responsibility in any such case and the Clause clause 10 (Indemnification) of Indemnification this Agreement shall be applicable.; ii. b. that Quick Heal assumes holds no liability/responsibility for any data deletion, including but not limited to any deletion/loss of personal, and/or confidential data; and/or uninstallation of third third-party apps; and/or change in settings; and / or change in contacts and / or Deletionand/or deletion/loss of contacts, and/or SMS logs and call logs; specifically authorized by You you or occurs due to the actions, inactions (whether intentional or not) by You you or any third party whom You you have authorized to use, handle your Device due to features of Software.software; iii. c. that to avail/use certain features of the Softwaresoftware, you may be required to incur some additional cost and that Quick Heal does not warrant that the usage of certain features of the Software are free of cost and that Quick Heal shall not entertain and expressly disclaims, any claim for reimbursement of any expenses including but not limited to any direct or incidental expenses arising out of Your usage of such features of the Softwaresoftware. iv. d. that Quick Heal may take backup of your device on its server; e. that you shall be solely responsible and shall comply with all the applicable laws, regulations laws of India and any foreign laws including without limitationor the territory in which the software is being used or has been activated, included but not limited to the privacy, obscenity, confidentiality, copyright laws for using any report, data, information derived as a result of using the Software.software; v. f. that while using the Softwaresoftware, Quick Heal suggests may suggest some actions to be initiated by You in you for your sole benefit, for example benefit (For example: “Quick Heal software may suggest You to uninstall infected applications”), however such actions are suggestive in nature and Quick Heal takes no responsibility/liability of the results, if you perform accept such suggestive actions or not and Quick Heal assumes no responsibility/liability for any liability arising out of such actions/inactionssuggestions.
